SF is probably THE most politically sensitive/motivated city in Ca. I wouldn't count out that factor in how this whole thing played out.

The place has been totally bananas going back to the days of DiFi.

Not implying the guy wasn't drunk, but a breathalyzer can absolutely indict the innocent. I was stone cold sober when I blew a .15 once. It happened that the just previous user was so lit the device needed to be aired out.

See my other comment. A PAS device cannot be the basis for an arrest. A Draeger device (will be used at the station/jail, after arrest) however, shouldn't have that problem as it purges itself between uses/blows.
