GF at the time was having issues and needed a place to stay. She moved in. It was him being nice not a love forever deal.

Fast forward. He wants her out.
Her car blew up. She is not trying at all.
He let her use Moms car to go to work. Added her on the policy. (Responsible)

She refuses to leave for financial reasons.

“I don’t have money to fix my car”. :blah

He just wants her gone and she is resisting.

What would you advise??

So, for starters, he will have to go through formal eviction and it is extremely expensive and challenging. It will be much easier to accomplish if he can prove he intends to move into the home. Squatters cases are weirdly harder in CA than Lease Violation evictions, because there is less paperwork to make his case.

First step would be to rip off the band-aid, have the hard conversation, and deliver a written notice to vacate in 30 days after the conversation. Sounds like he has money, so having an appropriately trained civil attorney draft the letter is the best thing. The attorney will advise it be delivered by a process server rather than him personally, which also is not a terrible idea.

If he wants to try and maintain a civil relationship on some level, a cheaper route and more pleasant, would be to negotiate terms for her leaving.

If she is using the car as an excuse, he should offer to pay to fix the car or even buy a shitty $3,000 car (cheaper than all the legal process) to have her move out on a certain date. Before being issued payment, he should have documentation prepared she must be willing to sign that includes she is required to vacate on a specific day.
If she reneges on the agreement, that could be the basis of the civil complaint for formal eviction.

Having an attorney draft or at least review that agreement is also advised.
 
I should have been clearer. He lives in the home. They were sort of dating when she ran into trouble and moved in. Guessing she was manipulating him from the beginning.
 
Move all of her stuff to the curb. And have an identical lock ready to install when she goes outside.

We all wish that was possible/legal, but not here in California.

Might as well advise to shoot her and put her through the wood chipper
 
Depending on how much the repairs cost I think he is making a good start. Most of my reply was tongue in cheek and I have never dealt with this situation per se. I do have a habit of not staying where I’m not wanted tho. Hope it goes smoothly for them.
 
Getting off his ass is a good start.
He is smart so I doubt he’ll make any huge mistakes as ST Guy suggests. :laughing

A neighbor of mine bought a rental house as an investment. His very first tenant turned out to be a deadbeat. He went over and confronted the tenant and lost his temper. The tenant immediately called the police and then got a retraining order. It took him like 6 or 8 months to get the guy out. After he fixed the extensive damage, he sold the house.
