As a legal matter, paperwork with a signature is not useless!

I told CA a long time ago that I sold my r6 out of state, they kept pestering me because the owner never registered it (track bike). They threatened to suspend the reg. (what the hell do I care, it's not mine) and I did ROL both online and by mail.

Bah! I hate this crap and it sucks that you have to deal with it. Totally jacked system for sure.
My DMV nightmare was with a non op RV whose plates were stolen; DMV ended up attaching my disabled son's SSI bank account because it had my name on it.:wtf Took a full year to clear it all..and a year later it happened all over again.:(

Hope the nightmare isn't too on going from here....

Something still doesnt add up.

You have the ROL on file. The vehicle was towed and the new owner paid for the tow. The tow yard can only release the vehicle to the owner.

Honestly, I think your best option is to go to the agency that issued the ticket and have them re-run the plate.

Don't pay the ticket because that does not mean it wont happen again.

I know! I've spoken to 2 agents from the Parking Authority in Oakland.

Both said that the last registered owner was myself, but the truck was recently registered in '12 -- after the ticket was issued.

Actually, the Tow yard kept the vehicle. In the original link, the $500 pay out was to satisfy part of the storage fees. So it was $500, and they kept the truck.

I can only assume that they somehow resold the truck and now it's back on the road. Not sure how exactly my name was still attached to the truck during this whole time?
 
So, the way it works is this:

I Rel, buy a truck from Stan. Stan sends in the ROL, I never register it. DMV shows that Stan sold the truck in 12. Stan's name will remain attached to the truck until it's registered in someone else name.

The ROL is just that, a release of liability.

Yes, you were the "last registered owner" of the truck. This is true. However, the ROL should "should" keep you from getting these tickets. Sadly, you are suffering from the actions of someone else who didnt do their job.

As I said before, even the fact that my bike was reported as stolen didn't keep me from getting a courtesy notice for equipment violations in the mail :rolleyes

That was not a DMV issue, that was a cop issue. The cop did not check to see who legal owner was.
 
No, it was a DMV issue. They allowed 2 vehicles to be registered under the same VIN, and now refuse to release me of liability for it when multiple LEOs agree that my bike did not have the VIN on the paperwork.

Take a digital picture of the vin, and your plate, along with any paperwork you have from the dealer or seller.

Fill out a "statement of facts" form, from the DMV, and tell them to fix the mistake and to release you from the citations.

Make and appointment with the local DMV and ask to speak to the manager.

Amazing how difficult we have to make things.....

OTOH, can someone really train (even a manager) for all the vehicle code permutations CA generates?

In my case, I bought a good but damaged car back from insurance and paid "all" the fees necessary to non-op it. DMV failed to tell me it needs a re-cert (match VIN# to motor/tranny) to complete the transaction. And the bills and fines kept coming....

So, you need a CHP inspection? An REG343 form?

My paperwork matches the VIN on a bike that has a different owner, documented from before my bike was stolen. I have no clue what VIN was stamped on my frame, and the dealer was closed a long time ago so while multiple CHP tried to find it they didn't have any luck.

My bike was stolen September 2009 (don't recall date). I got a courtesy notice in the mail this summer.

The CHP I had previously talked to, who had initially contacted me when the bike stamped with the VIN my paperwork shows was sold, was good enough to take care of the ticket.

I have no pictures that show the VIN. I bought the bike from a member of Oakland PD, and was naieve enough to not verify VIN.


If you're willing to investigate I would greatly appreciate it - I'm sure my bike still exists *somewhere*.

VBKEXN4034M780663 is the recorded VIN, my plate was BKNITIN but there should be another record for that VIN as well.
edit: there may be my original plate: 17H7913 as well as my vanity plate, AND another plate


The most likely scenario, having talked to multiple people, is that the dealership used the wrong paperwork for my bike, and then used it again for the other bike. DMV didn't catch it, so who knows what ever happened with my bike.
 
Take whoever you sold the truck to to small claims court. Claim the hourly rate that the company you work for bills out internally for all the time you have put into this.

When was the last time you went to small claims court? You do realize that even after a judgement in your favor doesnt mean you actually get anything. Just means the courts agree that your in the right. Still have a ton of leg work (of your own, the court/s really doesnt help, if at all) to get anything from the judgement.

Congrats, your in the same boat I was a few years back on a truck I sold to a guy down south, SD. It got tickets and citations, etc. In the end the tow yard that picked it up lien sold it, and it was registered to some one new. I honestly think that is where the paper work failure happened. The state has many different types of paperwork for lien sales and rarely are they filled out correctly. Of the cars I have purchased through lien sales, only one (of 8) was filled out correctly. In the end I was filling it multiple sheets for SOF and spending more money they the car/s are worth, to me, just to finalize the paperwork. IMO, the state makes it hard to file anything so they car make more $$. Though what isnt understood, it still costs them $$ to make US jump through hoops.

6 years ago I turned in a release of liability for my old integra to the redwood city DMV. Two years ago I filed my taxes and declared my auto registration fees in my taxes. A month goes by and I get smacked with a legal order for roughly the same amount as my registration, plus a legal order fee. I chalk it up to the claimed reg fees. Not gonna do that again, I thought, even though realistically I shouldve. This year I get hit with another one with the license plate of the integra. Called up the state and the DMV and eventually had to do a verbal release over the phone to get it straightened out. Got all my monies back, minus the legal order fees.
