I need help with a crappy dealer..

I need some help. In June I went down to L.A. and bought 2 aprilia's from a guy that calls hime self Dr. Bob he ownes Trump Motors in tarzana ca.
He mostly buys wrecked ducati's and sells parts.

Anyway One bike had a title with it and the other bike was waiting on the lein sale paper work from Co-Part. He was a dealer and I had friends that have bought from him so I paid for the bikes and took them home. I waited and waited for the paper work and he kept saying that its in progress and that they are working on it. Then he had a family emergency which delayed it more. He now says he has the paper work on his desk but is refusing to send it to me unless I send him a letter or email stating that I will not sue him for any reason and our deal was concluded as is. WTF is that all about.

I live in Northern Ca and really dont want to go to L.A just to take him to court. Is there any DMV recourse I can take since he is a Ca lic Dealer.

Oh and one last nugget of info. I found out later that he was a wholesale only dealer. He isnt allowed to sell to the public...
 
I cant register the bike since its in his name. His also hid the fact that there are over $500 in back fees on the bike.
 
Is there something he knows that he didn't disclose?
 
It probably says totaled (not salvage) in the title which means its un-registerable.
 
Do you have a bill of sale ? Did you list the actual sale price, or something lower ?

You don't have a lot of options if you don't have a bill of sale, or the recorded price is less than you actually paid
 

Yeah, but good luck getting a timely resolution, if you were to get one at all. Regardless, it's probably useful to read up on the process, file a complaint and then call the dealer to explain what is happening.

You should know that DMV has limited resources to review and catalog these complaints. Your information will be reviewed by Investigations and Audits and/or Licensing Operations. Not all complaints are investigated

If the title Dr. Bob owes you is clear and gets you out of the predicament, perhaps the best way is to abide and move on. Of course, if the title has strings attached, then you wrote off all recourse.

Try a condition waiver, i.e., you won't sue if the title is clean and in your hands within 5 business days. Ask him to fax/email a copy of the title with the word VOID across the image. You won't be able to do anything with it other than vet the title is good.
 
Email him and tell him you'll bring the bike back to him this weekend, and you request that he have a cashier's check in the amount of the original sale price $XXX waiting for you. See what happens.
 
I am willing to eat the $500 for DMV not that big of a deal. If all it tok was paying the back fees that would have already been done. Right now I am stuck with a bike I cant register or sell. I just want to register it and ride the damn thing.

Give him a choice. If you have friends who live down there, they can probably file the paperwork in small claims court for you (assuming cost was less than $5K) so you will only have to travel back down there once.
 
Very few bikes from Copart are clean title. Even fewer are on lien. They usually give you a salvage cert which you then hold on to while you jump through the hoops (brake and light, tax to CA, DMV, possible CHP for Vin verification.) If he has a salvage cert and you can get it, you can (theoretically) get it registered. If like someone else stated the bike has been tagged as "non repairable", then you are shit out of luck. Have him send a picture of his paperwork (which he probably will not at this point) and I can tell you your real options if you'd like.
 
I have build a lot of wrecked bikes I know the pain in the ass of a salvage cert. The other bike I got from him was a salvage cert and its already done and registered. I just asked him to send a photo copy with VOID across it and he said no. He is still holding to saying that the bike is a clean title and the lein sale paper work is finished and on his desk, but will not send them until I send him a letter stating that I will not sue him for anything.
