bonus points for being caught "on videotape" and not "because they videotaped it and put it on youtube."

doesn't seem like a felony, unless somebody got some fecal disease from the poop.

maybe it would rise to felony if it had been a flaming bag of poop. arson and all.

I wouldn't want to eat food from a place covered in shit but then I remember another news bit about all the fecal matter on grocery store shopping carts in SF

I'm a total n00b when it comes to legal process on this, but ...
I think that the only way they can get a conviction on a felony count is if the prosecution can prove willful intent on the part of the kids. I'm guessing they just put the poop in there to make the store smell real bad and never intended for the freakin' microwave to explode. In order for it to become a felony you have to prove they were intentionally aiming to cause massive damage to the store with a poop-bomb. Not only that, but they're juvies, so their sentencing won't be as severe as if it were an adult.

Sounds like the prosecution is gonna be shit out of luck on this case.

Dollar amount of damages can count. Look at shoplifting: over $400 is a felony vs misdemeanor.
 
:laughing That crap's pretty funny. (no pun intended, for once) Felony is a little extreme, but I'm sure the shop owner is plenty mad. Hope they get a good lawyer who knows his shit. (ok, pun intended that time)

Isn't there a set dollar amount where it automatically goes from a misdemeanor to a felony? I thought that the dollar amount was $2,000. So, I think that's why it's being prosecuted as a felony. They will most likely plead it down, but that's the way it's coming off right now.
 
That's a crappy reason to forever lose your right to own a gun. Guess they'll be restricted to throwing poop at people they don't like.
