However, in District 9 we have received very troubling news today about the emergency

As an outdoor family, our family and friends have raised our children to be outdoor
enthusiasts. Our sport is Off Road and OHV trips, camping and family time outdoors.

We have used this avenue to raise kids that are aware of the environment we live in,
and to "tread lightly".

However, the emergency closure of the Clear Creek Management Area has put thousands
of families at risk of not having an OHV area to enjoy.

All of us our shocked that after 30 to 40 years of patronizing CCMA, we are now told the EPA's
action is for our protection. How are we threatened by CCMA sir? The BLM has done a great job
at managing the area, and the last time we checked, not one person has suffered any illness
by repeated (and in some cases hundreds) of visits to CCMA.

We ask you to please help us lift this "Emergency Closure", allow the EIS to continue,
and give the BLM the management over the area they have without closure.

Our families need CCMA.

I just scoped out the open house. Pretty Cool.

The meeting is in the "Elizabeth Hang Theatre". Tickets at five, doors at six. Seriously. The theatre holds a little over six hundred.

Papi from SBR is probably a good voice for us, but we need your bodies there to demonstrate our significance. The begining will probablly be informational on the health risks of asbestos, then, I dunno, Q & A? I imagine it will get pretty lively.

I was there last night and I have a few comments:

1) 1) I was impressed with Papa. You are very articulate and make a great spokesman for the dirt biking community. Good job let me know what I can do to help.
2) The EPA did a very thorough job on their test of asbestos. They did the statistical analysis and presented a good case that asbestos is present and according to OSHA safety standards, it is concentrations are great enough to be harmful. However, there was no third party to validate the data. If the people are analyzing the data and are biased, then they could easily bias the data to meet their agenda. Everybody knows who the EPA is and what they represent, so it is no surprise at the outcome of the data. The test needs to be done by a third party to insure the data is valid and not biased. By does anybody remember the MTBF disaster caused by the EPA? Was there a third party to review their data that could have stopped that? We should demand a third party test.
3) I think the best argument we have is the risk more injuries caused by overcrowding of our existing riding areas. Where are the estimated 35,000 off road riders going to go? Hollister is an absolute zoo, I can’t remember the last time I went there and not seen an ambulance or an emergency air vac. I think we could argue the risk of injury do to riding in overcrowded ohv parks far exceeds the risk of disease caused by riding at CCMA.
4) I liked the idea that someone had of donating our federal rebates to the BRC. I’ll take it one more step. For birthdays, father’s day, etc. I’ll donate money to BRC in that person’s name. This will be great to piss off the liberals in my family. I know what my father’s day gift will be to my dad (he’s a dirt biker, so he’ll dig it).
5) I know of one or two Bay Area celebrity who might be sympathetic to our cause. Dr. Bill Wattenberg from the liberal news talk radio station KGO is very critical of the EPA (listen to his show; he spends hours railing against the EPA). I’ll try to e-mail him and see if he has any interest in this asbestos test. Another potential ally is Dr. Michael Savage on KNEW. He has a PHD in epidemiology and might have some insight on the risk of asbestos in a natural environment. His son is a big wig for Rockstar Energy drink that supports motor sports like supercross and motocross.
6) I’m starting my letter writing campaign ASAP.
 
The closure of CCMA is depressing, to make matters worse, San Benito county is thinking about seizing this opportunity and sealing off Idria. They tried to sell the town at auction earlier this month but thankfully some people at three rock research were able to put a hold on things.

Not only is CCMA a great place to ride and wheel, it is also packed with history.

Now that i can do all of the hardest trails at Hollister too :( will i have no where else to step it up?

That must be why all i hear is "Jawbone" since its prob the next best thing.

I asked the BLM for electronic versions to post, but no response.

There is a one page "Public Scoping Worksheet" that is pretty good.

I'm thinking we should fax them. Faxes are a little more difficult to delete than emails.

Since I'm the guy who wrote one of the threads you posted here, I thought it would be best to join this forum and reply to you personally.

On LA Rocks, I am BR Rockshoppe, AKA Rick Kennedy. I am a local Benitoite fanatic out of San Jose and people on that forum and others look to me for information about the Benitoite Gem Mine, one of the many jewels of the CCMA. Since the time I wrote that post, Dave Schreiner, the owner of the mine has not been allowed to bring a single customer to his mine and he is suffering financially because of this.

I am very much for allowing this man and his customers access to his own private property, but I also believe quite strongly that the area should be open to all.

Kim Noyes (He's a guy by the way) does not represent myself or most rockhounders, we gotta drive our 4 X 4's anywhere we are going to collect, so we're the bad guys too according to the EPA. Also, in a later post, Kim apologized for his poor taste in words.

conditions? It has been my experience that one does not go to the
doctor and ask for a pneumonia test if one has no symptoms. If enough
people get sick that share a hobby or live within the same area, then
concerns are raised and scientists try to find out 1. If there is any
connection and B. What that connection is. Once a concern for public
health is established, then government gets involved to try and help
solve the problem. In this case, just the opposite has happened, the
government has been trying to start a fire where there isn't one so
they can get credit for putting it out.

First of all, Chrysotile is a more brittle mineral than the amphibole
asbestos minerals. Studies have shown that it breaks down and leaves
the body at rates up to 5000 times that of amphibole asbestos.

The recent EPA study was minimalistic at best, samples having been
collected during five weekends and a total of only 250 or so samples
to analyze. They only sampled routes from the Clear Creek watershed
and did not differentiate between those samples by route. When you
are trying to measure a risk that is considered hazardous at a 1 in
1000 rate of cancer, thousands of samples should have been analyzed
from all over the CCMA and the different routes and times of day
should have been broken down and studied.

The "Smoking Gun" of the EPA report was that even during the wet
season, asbestos exposure was similar to that of summer. That was
based on samples taken one weekend in November 2004. Even the authors
of the study said that they were surprised by this outcome. Instead
of applying proper scientific method and retesting under similar
conditions to check their data, they simply explained that they were
confident that their data was good. It is this part of the study that
I believe forced the BLM's hand into ordering a full rather than
seasonal closure for the area.

Medical records for people associated with the area have not been
looked at, no study has been done to see if there is any correlation
between the people that frequent the area and asbestos related disease.

So what's the agenda? You got me. It could be that it is just too
expensive to maintain and the government would like to save the $$.
It could be that the EPA is looking to expand the Atlas Superfund Site
into the entire CCMA so it can show Congress how it is putting out
this huge fire and keep people employed for another 20 years. It may
be that there have been too many lawsuits and they feel they can avoid
future litigation by closing the area.

What I do know is that this is a fight and that all people who enjoy
the area need to stay focused and not in-fight. Mineral collectors,
Lapidarists, Private Property owners, OHV recreationalists, Hunters
and commercial miners are all in this together. We are an odd
coalition, but could be formidable.

The lady from the EPA made their agenda PERFECTLY CLEAR to me at the Santa Clara meeting. When a guy asked her if they tested any of the animals in the area for asbestos related issues her reply was...."You mean the ones without tire tracks on them?"
