ok i have this situation going on,dude A gives dude B a helmet and then a day later dude A wants it back cuz he found out that dude B has 1 more helmet then the one he wears,that shouldnt even matter!,can he legally take it back even though he willingly gave it to me and i have proof of it that it happened,why would you give someone something and then take it back the next day!?

What was his reason for giving you the helmet? And what is your "proof" of his giving it to you?

cuz i needed a helmet was the reason,i thought he was very nice enough that he did that,and it is on barf saying he gave it to me and i have text messages from what he said too
 
he is declaring theft on fraud....and supposely is going to take me to small claims court :|

Maybe because he no longer wants you to have it? From what I gather from the story, he thought you only had one helmet...maybe it's ratty and ugly and he felt pity for you...then he found out you have a 24k gold plated helmet sitting at home on the shelf...so that pity he once felt for you is gone.

Give the guy back the helmet...no, he shouldn't have gave it to you if he didn't want you to have it, and no, you shouldn't keep it. At this point I don't think either of you is too deserving - but on the limited info I have, I'd say you are the less deserving of the two.

dishonest? about what,ive said nothing to make it seem like that,he said he found out from someone that i had 3 or 4 helmets which is untrue,i only have the one i was wearing and a spare,both arent in such great condition,that shouldnt matter how many helmet i have,he could of easily said no to giving the helmet to me,no one put a gun to his head and told him to do it or else, he seemed very fine with it when he did that and didnt seem to mind,then the next day he changed his mind and starts threatening me saying if i dont this and that,if u gave something to someone and want it back for no good reason then that doesnt make any sense at all

Given that the guy sounds like he was under the impression that he was doing a good deed by providing superior gear to someone who appeared that they sorely needed it, I think it would be most fair and sporting if you kindly returned the favor, since you DON'T need it as badly as he thought you did.

I'm curious, how did he end up giving it to you, or what was his reasoning? Did you ask him for it, or did he just look around, spot you and say "here, take this, you look like you could use it!"? I would say that no matter what you were dishonest in taking it for free, because you either gave him a story that you really needed the helmet because yours was jacked up, or you intentionally neglected to mention that you had another, perfectly serviceable helmet at home.

As much as I would appreciate and be touched by the offer of a stranger like that, there's no way in hell that I would accept something like that for free, knowing that he or she won it fairly and I had a fully functional helmet at home. I just wouldn't feel right not mentioning that to him or her, and certainly wouldn't intentionally omit that detail.

Even if he or she offered it knowing that I DID have a good helmet at home, I still wouldn't accept it for free - I would likely offer to pay at least a token amount for his kindness. Do you think he would go for something like that? Throw him $100 or something? By your own admission, if he wants to take you to small claims court my guess is he thinks you intentionally deceived him. Why would he think that?

I hope it works out well for you. I'm not sure if you remember Andy, but we did meet and ride once on an SCC ride months ago. You seem like a good guy, and I hope you do the right thing. :thumbup

so you had two helmets, and he gave you a third, but it's untrue to say you have 3 helmets?
