Got taken out on North main by Treat intersection

North main just before Treat intersection. yesterday around 2L45pm.
I was in the right lane on the left side of the lane when I saw the nose of a car poke out. I rolled off the throttle and moved into the left lane, saw the rest of his car coming out and dove as far left as I could while nailing the brakes and BAM! right into the drivers side door.

He came out of the new Wendy's driveway on the right and kept on going across to make it to the turn lane. F**ker wasn't even looking as he bolted across 2 lanes of traffic. He was looking right the entire time. He said he didn't even know I was there until I hit the side of his car. He would have been screwed if I was in my Jeep or if there was any other traffic for that matter.

Anyways, I hit the car with the right front of the bike then after smacking it, it spun me and put the right side of my body right into the car then dropped half on the median and the street on the left side.. My right leg got pinched between the bike and car and my right shoulder and helmet bounced off the door and upper door jam.

After I hit the car and came to an abrupt stop, all I could think about was getting out of the street so I hobbled the 2 ft to the median and sat there. Then laid down as I started hurting. Holy hell was I pissed!!:mad

Myself, well, I got lucky. My boots took the brunt of it and so did my helmet. I have a sprained ankle, had a dislocated shoulder and a bruised hip.

Here's some picts of the bike at the tow yard after I pulled all my bags off. They're from my cell phone so you can't see all the scratches and cracks on the fairings.

Rear set and heel guard is touching the swingarm from my ankle. Also broke the rear brake resevoir andthe exhaust heat shield

Yay gear! Glad to hear your injuries aren't too bad. Your bike could be worse off, too.

Get any witnesses? Police report? Other guy have insurance? I'm assuming he was at fault for violating your right of way.
 
+1 on wearing safety gear and minimizing potential injuries.

Hopefully the car driver stuck around, carried insurance, the police report shows the car driver at fault and you/bike will be fixed up and riding again soon.

Sorry to hear about that and glad to hear your going to be ok.
I live about 1/2 a mile from there and am always super heads up riding through that area, it's a disaster area waiting to happen.

Thanks guys! Yes, gear, I won't ride without it. My boots saved my ankle big time and the helmet saved my noggin.
Within 2 minutes of it happening, there was WCPD, ambulance and fire. Super quick to respond! I swear, within 5-7 minutes I was being loaded in the ambulance.
The guy stuck around and was constantly asking if I was ok. I was starting to feel the pain so I didn't talk to him but he got my name and address. The cop put the other guy at fault and told me so as I was being loaded up. I'm assuming the cop got all his info but I requested a copy of the police report just to cya. The guy was an older guy, prob in his 70's so I'm more likely to assume he's covered then if it was a younger none english speaking driver.
I can't wait to get back up and running but unfortunately I'm real worried about my shoulder. I can barely move it without it hurting stupid bad. I go back in 4 days to get a work release but I may snag a lawyer just incase.
As for witnesses, there was like 4 on the sidewalk and about 15 inside Wendy's. Plus an off duty EMT that was at the stop light at Sunnyvale that saw it happen from behind.

ditto what motoguy said and sounds like you got all your bases covered, hopefully also the witnesses filed a report? heal up fast man and get some pain and suffering too cause you deserve it, then spend it on the bike lol!

Yeah, it was funny watching the doctors try and figure out how to get the rings out. 1 ball went flying somewhere in the room and we never found it.

As for my avatar, yeah, she's hawt. shes one of the model for Sikspak clothing and stickers.

From Google maps, that looks like an illegal left turn?

The sports doc in WC who did my ankle surgery is supposed to be really good at shoulders, if you need a shoulder doc.

Not sure if it was illegal because tech. he wasn't turning left. He was basically going straight across both lanes to get to the turn lanes that were just a hair to the right of the Wendys exit. (If you were exiting Wendy's)

Make sure that nowhere on that report does it say you were speeding...otherwise it could go down as a percentile of fault and you will get stuck paying whatever percentage is arbitrated by the insurance companies. Just saying it's the small print that the insurance companies/lawyers start reading after the driver admits guilt.

I'll find out when I get the report. I was no way speeding though. The cop just asked me how fast I was going, so I told him, then he asked how it happened, again, I told him and he said ok. A couple minutes later he comes back with my wallet, tucks it into my boot that was laying on the gurney and says, it's his fault, here's my card and the report number if you need anything, hope your ok, then left. I couldn't tell whatg he looked like or anything as I was already loaded in the ambulance and on the backboard with a neckbrace.

Well glad that you are ok for the most part! I only bring that up because it happened to me. So guy was blazing through a parking lot, and t-bones me spinning me 2x around as I come into the lot from the street, he's doing like 35 and I told the cop I was doing like 10mph and the insurance companies said that I was 25% at fault because I was going over the speed limit for the parking lot. Didn't find that out until they were settling as the insurance company was representing both of us and made the decision...grrrrr. Hope you are back on the road soon! :)
 
My best friend was the Paramedic on the fire engine that responded to you. If he gave you anything less then A+ service let me know, I'll let the air out of the tires on his pickup truck..

I was just wondering with hind sight being 20 20 and all. Is there anything you could have done to avoid the acident? You saw him comming out of Wendys, could you have slowed down more or swerved. I'm not trying to rub salt in your wounds, just wondering now that its behind you if you think you could have done anything different? Thanks and heal up fast.:ride
 
The insurance companies make way more money if fault is assigned to both sides. They like to spread it around-- even if it was 2 separate companies, they'd try to work it out that way between them.
