I am pretty sure it has to be DOT approved, and be marked as such. I think pretty much all the aftermarket lighting stuff in not in compliance with the law.

No vehicle shall be equipped with any lamp or illuminating device not required or permitted in this code
, nor shall any lamp or illuminating device be mounted inside a vehicle unless specifically permitted by this code. This section does not apply to:

(a) Interior lamps such as door, brake and instrument lamps, and map, dash, and dome lamps designed and used for the purpose of illuminating the interior of the vehicle.

(b) Lamps needed in the operation or utilization of those vehicles mentioned in Section 25801, or vehicles used by public utilities in the repair or maintenance of their service, or used only for the illumination of cargo space of a vehicle while loading or unloading.

(c) Warning lamps mounted inside an authorized emergency vehicle and meeting requirements established by the department.

So where do I find the list of lamps or illuminating devices required or permitted in the vehicle code? If it was wired to illuminate with the brake lamps as an auxiliary light would that be ok?

I dont personally know of an easy list that exists, but the VC spreads what's 'required over however many pages of codes. (Also, IANAL :x)
 
Buy it. Put it on your bike. Don't be breaking ANY other laws (especially noise) while you use it. Be white. Put it on a switch so you can turn it off. Have a damn good reason for having it on your bike (have a tasty back story). BE WHITE, and you'll be just fine. :thumbup

My racial bias? I don't know anything about that. All I know is this 40yo white guy shot up his street and the six officers that showed up told me to just let the colored folks into my house before I started shooting next time. My bias, your bias, six in one hand, half a dozen in the other. I don't know for sure. All I know is it sure helps to be white when breaking the law. I love the police, but I am white, so take that with a grain of salt.

In California anyway, you can't add a light that's not DOT approved and it has to be "allowed" by Title 13 and the CVC.

So all the integrated motorcycle tail lights are illegal technically? Most cops just don't care I guess

I think LEOs have to prioritize how they spend their time. And laws are tools they can use to deal with some there problem.

Some the laws and codes make little sense. Cops use judgement, as should we.

Yes, and rear turn signals are required to be a minimum of 9" apart as well. If you put a fender eliminator on your bike, there's a strong chance it's illegal. California doesn't specify that, but federal law does, and California says your vehicle has to comply with federal law.


Applicable codes (bold my own):

CVC 26103 (a) The department may adopt and enforce regulations establishing standards and specifications for lighting equipment listed in Section 375 and for safety belts, safety glazing material, safety helmets, sirens, tire traction devices, bunk stakes, and synthetic binders. The standards and specifications may include installation and aiming requirements.
(b) If there exists a Federal Motor Vehicle Safety Standard adopted pursuant to the National Traffic and Motor Vehicle Safety Act of 1966 (15 U.S.C. 1381 et seq.) covering the same aspect of performance of a device, the provisions of that standard shall prevail over provisions of this code or regulations adopted pursuant to this code. Lamps, devices, and equipment certified by the manufacturer to meet applicable federal motor vehicle safety standards as original equipment on new vehicles and the identical replacements for those items need not be certified to the department.

FMVSS Section 108, Turn Signals (Motorcycle Column) -
At or near the rear--1 red or amber on each side of the vertical centerline, at the same height and having a minimum horizontal separation distance (centerline to centerline of lamps) of 9 inches. Minimum edge to edge separation distance between lamp and tail or stop lamp is 4-inches, when a single stop and taillamp is installed on the vertical centerline and the turn signal lamps are red.
 
So is it morally wrong to use the tail lights or is it another pointless law nobody really cares about? I got one when I got my first bike and I've never had a single issue with law enforcement. Except that time I had no mirrors or headlight. Hayward PD was not pleased :rofl
