Even if it wasn’t intentional, how does this not constitute causing death during the commission of a felony? It seems like this guy should literally be defending his life in sentencing if the justice system had worked.

i got kicked off of a jury during the selection process when the prosecuting attorney asked me if i believed in the jury system. i said no. he seemed shocked and asked me to explain. i was sitting in the jury box at the time, and i looked at everyone sitting around me and said 'no offense to my fellow jurors, but i don't think the average person is smart enough to make these kinds of decisions'. he looks at the judge and says 'the prosecution would like to thank and excuse juror number 7'.

The prosecution put the man on trial, and the defense countered by putting the gun on trial ("hair trigger", no external safety, decocker not noticeable enough, etc.).

It is interesting that the guy was charged with possession of the gun, but not held responsible for what happened with the gun while it was in his possession. I believe the "gun wrapped in t-shirt" story was his third story as to what happened, and the previous two stories involved him knowing that he had a gun in his had? I guess the third time is a charm.

I recently read an article written by the defense attorney listing several cases of accidental discharges from handguns (from putting gun in holster, from shirt catching on the trigger, etc.), so he must have been successful in convincing the jury that the gun could go off so easily that unwrapping the shirt/cloth made it go off and therefore the defendant is not responsible for the act when it happened. I suppose anyone charged with a gun crime should now deploy the t-shirt defense.

We will probably see more "blame it on the gun" defenses in the near future. Then comes more California gun legislation to "make guns safer."
 
I take gun ownership very seriously.

The BLM agent didn't when he left his gun in his SUV.

Zarate didn't when he picked the gun he claims he found.

Another thing is that a lot of my liberal friends who know nothing about guns are treating it like a magic object that suddenly went off when it was touched.

I don't see guns that way, and while it may be an accident (or a total con job by his lawyers), as soon as Zarate picked up a gun, he is responsible.

Ugh fuck SF and it's sanctuary city bullshit. If I was playing with a gun I found and had a negligent discharge that killed someone you bet your ass I would get second degree murder or at least manslaughter. Unreal. If SF and LA were to crumble into the ocean California would be better for it.

Sanctuary city has nothing to do with this.

Right now, ICE has a legal warrant to take custody of this douchebag as soon as he is released. No "sanctuary" issues with this now or in the past.

Previously all they (ICE) were willing to do (for a 4 time deportee who wasn't in the national news) was put him on a list for a "detainment request". Those detainment requests have been ruled by courts as illegal, and agencies have successfully been sued when they've complied. In many more cases people under detainment are kept in jail for a few extra days on your dime and then released because ICE never bothers to pick them up.
