Not sure if this is the right forum, but it seemed more correct than general

I am selling a frame on saturday. Title is clean and I am the full legal owner, but I can't find my title paper. It looks like the duplicate title request form will handle getting a new title in the mail and also handle transferring the title over to the new owner. I will be providing a power of attorney and bill of sale at the same time to cover all bases for the guy, but I had a quick question about answering the spot regarding the reason the title is missing.

It states that it could either be 'lost', 'stolen', 'not received', 'illegible', or 'paperless'...The correct choice is that the title is lost, but I am worried that this will mark the history of this frame in a derogatory way...Is this true? Would it be better to mark it as stolen or not received instead? I don't have the original title so I can't mark illegible as it requests that I attach the old title...I'm just trying to take the best course of action here as I don't have any experience with this at all

I don't think it will mark it as anything. You could just choose duplicate title and say you lost your original. It just means you want another physical copy of the pink slip. They create duplicate titles every single time you sell a car -- hence why it takes 3 weeks to get your "new" title in the mail with your name on it. I don't work at the DMV though -- they do some strange shit.

In addition to the duplicate-title form, most likely you'll need to fill out a form reg.256 - Statement of Facts and explain what happened to the title. This will help the buyer in getting the title transferred over.

I bought a track bike that was sold through 3 hands before me and was never fully registered. I had to get form reg.262 filled out (all-in-one title-transfer, odometer disclosure and bill-of-sale form) and statement-of-facts from each of the previous owners. If you bike is less than 10-years old, you need to use reg.262 instead of reg.227 because of the odometer disclosure requirement.

Luckily, they all lived in the same town and knew the previous one. So I pre-filled out all the forms and sent it out to the last owner before me. He was nice enough guy to drive to all the others and have them sign the paperwork.

Without that, it's possible to fill out duplicate-title form AND a statement-of-facts for yourself and state that you do not know previous owners and due to low value of bike, to let you register it.

I've had some friends buy junk cars that have been sitting for +10-years and they've managed to squeeze it through DMV by this method. There are multiple pathways through the system and I think it's partly luck-of-the-draw to get someone who's knowledgeable enough to find a way through.

I think it also helped that I went to the Los Gatos DMV. Previous attempts at the San Jose and Santa Teresa DMV got turned back. I think they have special instructions in Los Gatos to put in extra effort to get the rich folks through smoothly. Doesn't hurt to brown-nose a little and make them feel good. :)
