Man Kills Suspects While On Phone With 911

If that happened in CA he'd be up on voluntary manslaughter charges, no problem. Maybe murder ("I'm gonna kill them.")

I'm for defending your neighbor's property and all that, but shooting someone over petty theft? And it didn't sound like self-defense to me. No robber would approach an angry Texan with a shotgun in his hand. I guarantee you the 1st robber who was killed either stopped dead in his tracks or turned to run. If you listen to the call, you hear Joe saying the other guy was running away. I wouldn't be surprised if the fatal shots landed in his back.

breaking into a house to steal something is burglary, not petty theft. and they approached him on his property
 
I heard this all on the radio this morning. Good for him! I'll gladly contribute to his defense fund.
 
How did he shoot while on the phone with the cops? I wonder if he was using a bluetooth headset?

It sounds like the guy was surprised but that he wasn't in imminent danger. I obviously don't feel bad for the deadbeats he shot, but from a legal perspective it doesn't seem like a case of self-defense. Haven't been able to listen to the audio yet, my opinion is based on the text of the article.

Unless there's a law that allows the guy to shoot under circumstances other than self-defense, he's going to have to be locked up. The law, even in Texas, appears to not be in his favor in this case.

Seems like a tragic mistake by an excitable and easily frightened old man. Tragic not because I give a shit about the perps, but because he might have just given up the rest of his free adult life.

These two statements are going to send him to jail. He would have been much better to call 911 then get off the phone, but by staying on he demonstrated intent before any possibility of being threatened, then he didn't give any indication (by speech) that he wanted them to surrender.

I don't like thieves anymore than the next guy, but this guy wasn't very smart about how he dealt with the situation (both in saying too much and being too anxious to kill them) and it's likely going to cost him jail time and all of his belongings (lawsuits from the families).

You can't just gun somebody down outside of your neighbor's house, even if they were walking off with their property, just because you felt like it (don't know all of the details so this is a conditional statement), so if they were both unarmed and were both shot in the side or back (i.e. they were not moving towards him) then he's going to have a rough time defending his actions.

Yep, those two comments will probably land him in jail. Either way, there will be no more burglaries in that area. ;)
