Manteca Eviction

They have belongings and furniture there. They have mail there. Apparently because they failed to pay rent, their "friends" must give them a 3-day notice to leave per Code of Civil Procedure Section 1161(2)-(4) and that's fine. They have my place to stay at.... BUT

What is to be done about their belongings? If they in fact vacate tonight and start staying at my place....... what can they do with their stuff? Once again, can they throw it outside? Is that even legal? That is the main question here.

IIRC The landlord is required to store the items for two weeks... after the two weeks they may sell/dispose of any personal property

If I were called out to a landlord tenant dispute in your friends' situation I would tell the landlord he would have to evict them before he could force them, or any of their stuff, out.

Exactly. This is still a civil issue. They'd have to take it to civil or small claims court if they wanted to remedy the situation. Even if the law is on you side, sometimes it's better to just cut your losses. Hopefully they find use if a truck and get all their stuff out without further drama.
 
JFC, two people likely getting Unemployment and can't combine resources to pay a $400 rent? Don't seem like a recipe for future success.

I don't think they're on unemployment otherwise they wouldn't have this issue.
 
Your friend's story sounds fishy, I would bet they either did something bad or they were advised that they needed to move on, and now the home owners are getting pissed because your friend and her SO are overstaying their welcome.

Be careful inviting them to live in your home. You might choose to offer them a bed for awhile, but don't let them send mail to your residence, or move their shit in.
 
I already told them they can't move in anything except their clothes and a few blankets. I have trails of all my texts, emails etc... I monitor mail each day.. if I so much as see one piece of mail in their name.. they are gone.

I invited them to stay over for a few days, I'm pretty sure they can't claim that they live there especially if they don't pay rent or anything.

I've known her since high school but I don't know her Fiance that well.

They can damage enough to ruin your security deposit, refuse to leave when you do, steal your shit and sell it.

Consider not giving them a key-easiest way to protect yourself.

I knew a two brothers that invited a guy who just moved into town to stay at their place for the weekend. He moved out 6 months later :laughing
The guy was trying to sell a house in another state and didn't want to rent an apt until his house sold.
The guy was sleeping on the couch and was getting more and more comfortable with bitch about what the guys were eating, watching on tv...

There wasn't a lot they felt they could do, this guy was their new boss :laughing.

Its hard not to want to help a friend but I guess you cant be too carefully when inviting people into your home. Especially when they're running out of options.

Because it's a civil matter your friends will have to sue if their landlords do heave their stuff. Suing requires money...

And by the powers of Greyskull, be careful if you do take them in yourself. I always play it safe when it comes to my home might seem a little dickish or unsympathetic, but we've dodged at least two bullets over the years by adhering to caution.
 
Now, their "friends" are kicking them out and told them they have to be out of the house by midnight tonight...

They said that if they were not out by midnight, that they would dump their things outside on the sidewalk.

so, did their stuff get dumped on the sidewalk?
