To protect myself, I will immediately report conditions such as the above picture so in the event it isn't fixed and I do go down, I can file a claim for an unfixed hazard. Like the trenches that are forming between the lanes on 580 East at the Buchannan Exit/I80 interchange in El Cerrito, for example.
