Speed limit PHOTO ENFORCED??

I was riding down Telegraph in Berkeley last night, no traffic, doing 30ish. Posted limit is 25. While going through an intersection, I see the light turn yellow, so I twist the throttle a little to get through quickly. Some yellows turn red FAST and I didn't want to get caught in that - just trying to stay legal as far as that goes. As I pull through the intersection, I check my rearview to watch the light....did I just make it? It was still yellow. Then POP! A green flash goes off behind me! I was probably doing 40 to 50 at that point. When I drove by that intersection this morning, I saw a sign that said "speed limit radar enforced" and another that said "speed limit photo enforced." I always asumed "radar enforced" was meaningless. I mean, how would they ticket me with just radar? But photo enforced....

Firstly, this hardly seems legal with no cop there to ticket me, but that's not for me to say, I guess.

What I want to know is am I going to get a fat ticket in the mail? Can those cameras really capture my small motorcycle license plate in the pitch dark at 40-50 mph? And if you contest it, there's no officer to show up and argue the point. How do they handle that?
 
they dont need an officer to be present they have a picture of your liscence plate

Interesting I've seen one of these in I think it was cupertino sunnyvale area.

They are still illegal.

The most recent information I can find on laws to allow them were from early 2006. The bill was going to authorize the city of Beverly Hills to use them in a pilot program for 3 years. The bill was never passed.

If you get a ticket it will be for running the red light, not speeding.
 
always wear a black visor and when ticket comes in mail contest it and say it wasn't you and for them to prove it was you. If no face on picture you won't see the ticket anyways...they screen them first before they send them out.
 
Ask about your right to "confront the witness" in court.
Since there was no human behind the camera, the object can't testify.

But in your case about "speeding" - I think they mean that sometimes, the cops in vans sit there and take your picture. Since there is a human behind THAT camera, you're on the hook.

You're going to have a hard time contesting a speed ticket done at an intersection. The area has the benefit of being set up to precisely measure speed.

They don't even NEED radar, all they have to do is take time stamped pictures of you crossing the intersection. Known distance, known time, they can figure out how fast you're going.

WRONG. You have the right to confront your accusing witness. Period.

take it to court, judge will toss the ticket. but i think you would be getting a red light ticket if you get one.

i thought distance/time = illegal speed trap in CA

Really? I'd be surprised and interested to know why they'd do that. Seems pretty straight forward to me.

However, he is correct. Using a measured distance and time to calculate speed is a speed trap in CA. Makes little sense from a technical point of view, but the history is why this was outlawed. Whether is still makes sense, I don't know.
