VC 23123A Phone Usage - What do you think i do?

This is stupid. If you weren't "driving" the vehicle, then you have a vehicle left running just sitting in a lane of traffic without a "driver", and that should get the owner of the vehicle a ticket anyway :twofinger

If you are drunk at a stop light, it's pretty safe to assume you were drunk when the car was in motion. That logic does not apply to using a phone.

Do you think answering the phone at a stop light puts anyone in significant danger? Is it fair to punish someone for that? Really?

You could make the same argument for running a red light in the middle of the night where you can clearly see that there are no other cars on the road. Does running that red light put anyone in significant danger? Should you really be punished for choosing which red lights you're going to stop at?

Me too, if their phone use causes an accident. Otherwise, I think the current fines are more than enough to fit the "crime".

Please don't think that because the citation was dismissed that it is ok to use your phone (non-hands free) while stopped at a stoplight.

Based on the limited info you provided, I'm guessing the ticket got tossed more for the fact that you bought a bluetooth and took the time to go to court, than for your argument that you were not "driving" at the time you were seen using the phone.

I would hate for someone to think that since your case was dismissed, it makes it ok to do what you did. I've seen the same defense brought up at traffic court many times and it has always been a guilty verdict.

The judge is white and im middle eastern, so we are not even close to the same race.

BUT, yes i dressed nice and have a good attitude. Its part of being a respectful person in life. If i was a judge dealing with 10,000 rude shitty attitude people all the time I would be grateful when someone shows me respect. When you go to defend yourself you are acting as your lawyer, so you dress like one.

Being presentable and having a proper (not necessarily just good) attitude in a courtroom is appropriate action to take. I've seen judges hand out guilty verdicts (for various infractions) to people for wearing provocative attire, being late 30sec, and speaking with a chip on their shoulders.
 
I stated my case, and then i told the judge that I went ahead anyways and bought a Bluetooth, she said something along the lines of... "you've made some good points that i'm taking into consideration and moreover you have shown me that you are taking a step into the right direction buy buying that Bluetooth, so i'm gonna go ahead and dismiss it."

I said my thank you's and left a happy camper.

I think it was a mix of the DUI law where it says operating where as the phone says driving. The bluetooth that I brought into court also helped.

Our court has two different traffic judges. If you are stopped at a light and using a cell phone (not hands free), one will find you guilty and the other will dismiss it. It's all luck of the draw which one you get.
 
congrats on getting ti dismissed. You did your hw and it paid off.

I got a cell phone ticket months back. I knew I was caught and just paid it. That said the officer asked me if it was for an emergency etc etc. I found in the CVC that cell phone usage is permitted for such things as emergencies, medial issues, or some financial matters. It's not word for word, but you get the idea.

Also, just to stir the pot, my gf and I love trying to spot officers on their cell phones in their cruisers. We've seen a few. Kind of like the license plate game. We get all happy and point and go "ohhhhh" and then go on our way. :ride Some of them think they are above the law :dunno. And yes, the ones I have physically seen on the phone, who knows what it was for, but I'm willing to bet that most of those weren't emergency related.

^^^ this. Which is why it had spelling errors. Cause the light turned green before he could correct it :p
