What the hell is going on in CoCo Courts? Time for a new Judge...

well maybe they should just keep an eye on her and catch her violating probation which she will certainly do. Sucks she isn't locked up now but with a probation violation maybe it can still happen.

Fairly sure this is in progress.

Also, it varies by county and the Contra Costa DA’s Office is pretty spineless at times.

I assume the guys i was doing the work program with were also busted in Santa Clara County as well. Most were on their 3rd DUI's on suspended licenses etc.

In my case, it was some noob DA/prosecutor who wouldn't budge. Apparently had i gotten a more veteran one, it would have gone much easier/faster. In fact, i only got it dropped when a followup in court fell on a day the DA guy was on PTO, and the vet who filled in basically told my attorney what deal can be done to finish this and move on.

So if you know someone, i could easily see how shit like this can be done. It's not exactly fair. I'm not against doing time for the crime. But shit should be done fairly among across the board.
 
I don't believe that the release on facebook reflects the entire sentence. If it is a third DUI there is a mandatory minimum of 120 days (as a misdo) and a felony would be more. The defendant may have gotten probation but went to jail (or was in a lockdown in patient program).

In regards to recalling a judge, that is just BS. The judiciary is supposed to be independent from the court of public opinion. One does not recall a judge because one does not like a singular sentence. What happened to Persky was, in my opinion, wrong. (But I don't want to hijack this thread with my rant).

It’s okay to have opinions, even when they’re wrong...we should just live with bad judges? One doesn’t need a JD to see that this is justice denied.

This is a Persky-level mistake.
 
The electorate has the right to vote out a judge. They are elected officials. There are several issues with the recall process. One of the biggest issues is that a judge is precluded from discussing a case while it is still pending. That includes the entire appellate process. As such, the pro-recall people could lambast Persky, make up details that did not exist, and Persky would ethically bound from commenting. The judge does not have the privilege to defend themselves.

As I wrote earlier, it would appear that someone only provided partial details of the defendant's sentence. The result of which resulted in inflamed responses. I would encourage someone to go to the court and get a copy of the final minute order (the minute order with the sentence). I would love to see it too. That being said, I am not going to drive up to CoCo from SCC to do it.

“Non violent offender”

Careful what you wish for, voting public...

When people read “non-violent offender” they all generally think of personal use drug offenders. The picture is much larger than that.

Residential burglary, auto/moto theft, drug sales, DUI, etc... Also, what is charged is often pled down to offenses that are considered “non-violent.” Home invasion robbery or take over robbery pled down to burglary. Domestic violence pled down to disturbing the peace. Carjacking pled down to auto theft. Yadda yadda....

How difficult is it to get the final order? Maybe I'll give it a shot if I get bored next week...
 
It is easy to get the minute order if one has either the defendant's name or docket number.

Honestly having come to know and like two longtime drunks in the past five years, I now accept that alcoholism is a disease and that most alcoholics cannot find sobriety to save themselves or the people they harm.
