My friend Roger sits in jail. The department of homeland security are stepping up their efforts in tracking down the bad guys and US Immigration and Customs are on the hunt for the bad guys... That is good, but..they got this one wrong.. and I am bummed for him and our country.

Roger is an honorable discharged Marine.. but a Marine for life.

He served his term in Vietnam fighting for our country.
When he was ready for discharge he was told his country still needed him.
He went back and fought more.. his stories are vicious and heart throbbing.. he talks of the good men that died at his side.

He lost a more than a few in those years.

When he was discharged they offered him citizenship and he loved his homeland of Scotland and said no. In the flurry of coming back to his home here in the Bay Area, he did not sign permanent resident papers. Time passed.. he paid his taxes, became licensed contractor, married (3 times), raised kids, road his Kawi 500 and his harley and lived his life as a proud man. He got in a scuffle or two along the way, but he was as American as any other that you would find.

Thursday after the new age of computers provided info on all of us.. his number popped up on the horizon of terrorists are bad and ICE .. the US Immigration and Customs Enforcement www.ice.gov/ Roger had a felony conviction back a while ago for getting in an altercation and that was enough for them to do a sweep and put my bud in jail to be deported.

He sits in County jail waiting for a passport from the Country he spent the first 3 years of his life in.. so my government can send him home… to no one he knows.. to a land he cannot really remember, but the land he felt was his birthing Nation and that was enough to remain faithful to. At 62 he would not have a shot to come back here for 10 years.

He wears a badge of honor on his arm that say US Marines.. he wears a hat that says US Marine Corp. When he sees my other Marine friend he calls him Colonel. He says that with honor.. he lives with honor.

In these times of Security and worry that we have discontents and terrorists that may be here in our land, one Marine is being taken down by the lack of common sense. My friends have funded an initial Immigration Attorney and others are rallying to come to his aid.. a fundraiser will be held for this effort soon. Likely at the pub where Roger and I became friends - at Fred's Place in Mt. View.

Roger had a saying, “Up your kilt lad!”.. he is the stock that makes the US great.

The actions of my Government in this case dishonors all Marines IMO and if I could leave out the kilt I would just say “up yours”.

This is just wrong.

Period.

He has but a few days to fight back.. but he is like a prisoner of war and only a few of his friends can try and we are.
Some of you have met Roger.. he has been to the AFM Races, to MotoGP and the last barf bash as well.
I am looking for a picture of this danger to our country.. so you can see the face of a man that is obviously a huge worry to my Government.

ready to do anything I can Budman, just let me know :thumbup

this is of course, total fucking bullshit. Might be me next, if they decide not to renew my greencard, for whatever reason floats their boat :(

The Colonel did contact the Marines... not much I guess. The initial judge they went before refused to take action.. "I will not deport a US Marine" ... so they found another. :wtf :mad

I am venting.. looking for a magic pill.. :dunno

It is just so damn wrong.. and yes.. some were Citizens.. just crazy.. I should know more over the next day or two.. as our little group of friends fight for him.

This is what they make US Senators for. Get on the phone to Feinstein's or Boxer's office.

If you don't get anywhere fast with them, take it to the media. I can't possibly see how deporting a Marine will give anyone any kind of press coverage they are interested in having.

id take Feinstein over Boxer, also call the local reps. Anything can help. MY family used to be good friends with the Pombos, but hes no longer in office.

What Traq said...shoot, Feinstein put a bill together to grant citizenship to a Chinese Officer, I'd imagine they can try and help a Marine.

Otherwise, sorry for the idiocy, but I don't have any answers for you. Spent a good chunk of my life watching family deal with INS, and our process is so incredibly broken that I just don't know where to start.

former military and their families have been the most watched "potential terrorists" for years. Even my grandfather and grandmother got the "set aside" treatment for every flight and the ol' jarhead hadn't picked up his M1 since Korea.

This is what happens when political correctness gets in the way of actual security. We keep millions of "undocumented" on the benefits rolls for decades but kick out the Scots, Aussies, and Brits who didn't dot the i's and cross the t's while actually contributing to society. :(

Maybe he should start speaking Spanish and contact his local "community leader"..just sayin'

can he contact anyone in Veteran's Affairs?

Roger is an ex-Marine.. but a Marine for life.

Sux.

Not sure why he didn't become a US citizen when offered. Probably could've retained UK citizenship, too. Besides, once a Scot always a Scot, foreign citizenship notwithstanding...

Keep us posted on your buddy's situation... :|

Not sure why he didn't become a US citizen when offered.

Probably because, like me, he was born a Citizen of Her Majesty The Queen, and wished to remain so, regardless of country of residence or dual citizenship standing

;)

as mentioned, call you representative. They have some pull on this. Second...contact the media. US Reps also like to stand in front of cameras. Either the Rep stands there on your side, or you tell the media <so and so US Rep> refuses to help. That's politics and it works.

Hate to say it, but Roger is to blame here because he had so many opportunities to get his shit together and he never did it. Dual citizenship is not exactly uncommon (you don't mention whether the US would have forced him to renounce Scottish citizenship), and even after rejecting it he had 3 separate opportunities to get a green card through marriage.

Its very unfortunate that he now faces deportation, but thats what happens when you willfully let yourself fall through the cracks.

Not an ex-marine. Former Marine. Ex Marine = dishonorably discharged.

:wow

:wtf

Plenty of people here on PRs that don't want citizenship. Nothing wrong with it. There is, however, something wrong with shipping off someone that has served this country to one they barely remember.

And while it's customary for senators and representatives to help out their own constituents, it doesn't necessarily have to be one of their own.

Not sure if I can get them interested, but if someone puts the details together, I'd be happy to shoot a letter over to McCain's office.

Has he rethought the citizen thing?

Immigration and Nationality Act Section 329, INA

This section applies to members of the U.S. Armed Forces who currently serve or have served in active-duty status during authorized periods of conflict as outlined in the INA (WWI; September 1, 1939-December 31, 1946; June 25, 1950-July1, 1955; and February 28, 1961-October 5, 1978) or any additional period designated by the President in an Executive Order. This includes September 11, 2001 and after as an authorized period of conflict, which the President recently identified in an Executive Order.

* Have you served honorably in the U.S. Armed Forces during an authorized period of conflict?
* After enlistment, were you lawfully admitted as a permanent resident of the United States, OR at the time of enlistment, reenlistment, or induction were you physically present in the United States or qualifying territory?

Changes on October 1, 2004

Recent legislation has called for additional benefits to members of the military. These benefits will go into effect on October 1, 2004.

* No fees will be charged when you file for naturalization.
* The naturalization process will be made available overseas to members of the Armed Forces at U.S. embassies, consulates, and where practical, military installations abroad.

Sometimes I can't believe the stupidity of bureaucracy.

... the flurry of coming back to his home here in the Bay Area, he did not sign permanent resident papers.

So, could this be the reason they are going after him? Was he technically illegal in USA? It is just bizzare that they are deporting him for one felony that happened long time ago. How many times was he arrested including the times he was arrested but not charged? Immigration has their own rules when it comes to certain offenses.
