Has it been raining there?

I suspect it won't be there for MA in July. This is partially because it'll be dry AF and because they have higher safety standards than trackdays. It probably also won't be there for CRA in June.

Laguna has a repave on the books for late summer/ Fall. I suspect some will address drainage, etc at the same time.
 
I'm a little disappointed in the community's response to all of this. The pitchforks came out hard and fast. Kim had a case against some party and the system worked - a judge ruled that what happened was not negligent because he thought safety was maximized. End of story. This system is keeping trackdays safe for us. The boundaries of what is allowed were challenged here and further defined. Without occasional challenges like this, more people would get seriously injured. You shouldn't want to live in a world where someone can do anything because they got you to "sign a waiver" - a waiver that you never thought to care about until something bad happens to you.

As far as Kim having to pay for legal fees, that's hot garbage. Some law requiring such would make it so that only rich entities can sue. Since most here don't seem to be swimming in cash, it's easy to say that we don't wan't that. And there are enough people on BARF that its very very likely someone has successfully sued for negligence concerning a motorcycle injury. Perhaps the other parties will counter-sue for fees. Perhaps they'll win. And the system will have worked again because a judge will decide, not the mob.

Someone was literally trying to sue someone else for their own mistake. Just so happened to be in the trackday/ racing industry and well we all know how fragile that is in the first place. It really wouldn't take much to push it over the edge to be non existent. Shoot motorcycle racing here in the states flat lined but lucky got brought back to life not long ago.

Really? Yes I said "he MAY have even planned it", then I listed my reasons behind it, for example the corner (or straight), rider experience, the actual crash, my experience with documenting crashes and what happened after. I'm not the only one who had the same thought....If I knew Kim's character traits I would probably have a better idea. With what I have seen during my time at the track its not unfathomable it can happen.

We probably wont ever truly know... Kim was able to file a lawsuit based on his opinion the track should be liable for his crash and injuries and you agree. But If I have an opinion that he may have planned this you think my thinking is toxic and stupid.... At the end of the day my thinking and opinion ended up on the right side of this case.
 
JFC, why does anyone wonder why we live in such a litigious society when even some motorcycle riders think that this worthless douchebag had a case? The sandbags were there for a reason, they’re important during the rainy season and it is impractical to take them on and off in between rainy days. It’s not like the track parked heavy equipment in the runoff zones just for shits and giggles to create an unnecessary hazard, the sandbags had a legitimate purpose and are routinely deployed at many tracks in order to prevent erosion and provide a safer track surface.

If some of you are under the (false!) impression that you appear more intelligent or enlightened by playing devil’s advocate for this steaming pile of crap DK, you are dead wrong.

It seemed like a pretty simple question (since someone hit the sandbag and crashed, was it removed?). I'm also just wondering if anything about safety changed. For the sand bag I asked about, it was suggested it would not be there for such and such events because they have higher safety standards. Seems like most riders who commented don't really care if run-off areas are rideable and rather take the tack it's the rider's fault for leaving the track and more so if they fall. But I understand being defensive about it too.
 
So, yes, this question was answered in the judge's findings. You seem not to have read it.

The sandbags are all removed during competition season and put back during the rainy season. So the sandbags have come and gone several times since Danny Kim hit one.
