Fired for Riding Moto to Work

I'd take the job back, if for no other reason than as a show of good faith and forgiveness. But I'm with Weasie--update the resume. I'd also not show up on the bike ever again with that particular client. Work is hard to come by these days and a bad reputation, deserved or not, spreads fast.

No, but you should ask her for the $12.50/hr. that you were promised.

Point 1: she did NOT breach her contract (was this fact edited in after posts saying you breached ur contract?)

Point 2: and not frustrating, glad u got the gig back, and I loved the "F" in "ASAFP".
 
There are plenty of old people out there now. The pool of jobs in your field should allow you to find work very quickly.

I would not have her apologize to your bike. I do not think that she would understand why you'd want her to apologize to your motorcycle.


Let her apologize to you, and then when you get home, you can say whatever you want to to your bike. (I agree with DucatiHoney in that it would not be prudent to ride your bike to this client's house in the future. I also agree with DH in regards to why you should take the job back...)

While CA is a "at will work state"....you can still sue her pants off if you are wrongly treated. Sounds like all other cirumstances aside you would have a case simply based on your employer heckling you because she thought you were crying. You can release someone of their employment at any time.....but that does not mean you can underpay or mistreat that person.

A lawsuit is probably a waste of time.....lots of hassle for little reward.....but it might not be a bad idea to see an attorney if you are that upset about it. The mom sounds like she needs to get laid, well.

Fuck her, I think she's stringing you along for drama. Some people don't have enough in their lives, and she was probably left at the altar for a biker chick.

leverage this into getting the 12.50 you agreed upon in the beginning. Is 8 an hour even minimum wage these days?
 
I would accept the apology as graciously as possible, and apologize for giving any offense so as to mend that relationship as much as possible.

I might park down the street too if I ever had to ride the moto there again.
 
On the other hand, you knowingly broke a condition of employment. As a caregiver (it seems), you have a responsibility to be able to care for your charge, which you can't do if you don't have a car available. No, you haven't been asked to drive (yet) and yes, you would have had advance notice...unless there were an emergency.

except that she takes BART sometimes so she wouldn't have a car anyways... if what you said is the case, taking BART is also breaking the condition of employment as she wouldn't have her car in case of emergency's...

If she's not expected to have a car available, why would owning a car be a condition of employment?
 
What a strange and negative reaction to seeing your motorcycle. Not an intelligent response from her. Glad it's somewhat sorted.
 
Heather the quit fire at will is a sham. I have been in wrongful termination and won. I have an attorney in Oakland he is awesome and will listen to you for free and he'll be honest up front. He's not an ambulance chaser type attorney and knows his stuff. PM me and I'll reply with his firms name and number.



I would like too, especially since there was also a problem with me not getting paid what I agreed to (I agreed to $12-13/hr, not $8). However, my contract is at-will and says they can fire me without cause if they are unhappy with me for any reason.

I was very happy today because I rode my bike all the way (30 miles) to work instead of driving my Accord for the first time. But now, I am very sad because the mother of one of my clients (mentally disabled adults) happened to drop her daughter off at home this afternoon and saw my red Ninja EX500 parked on the street (the mom is usually not even there, but she dropped off the woman today instead of the bus dropping her off). She freaked out and started yelling about how motorcycles are not safe, so I am not a responsible person.

I usually drive or take BART. I was told when I got hired that I needed to at least own a car for when the client had an appointment in the evening (my shift is 4-8), but I have never taken her anywhere since I started 3 months ago, plus I would have been told in advance. Also, when I BART, the mom is okay with that method of transportation :-(

But, the mom is one of those people who thinks only reckless people ride motorcycles, so even when I told her I was getting my brakes replaced on my car (just dropped off for an estimate for possible work), she said that I shouldn't have bothered coming then. So, she asked me to leave immediately (after she was done yelling and making fun of me because she thought I was crying, but it was just red eyes from swimming).

How can I deal with future discrimination and negative stereotypes? I bought the bike to be practical and save gas, not get fired :-(

Sorry to hear. Unless it specifically state "no motorcycle" on the job in writing somewhere, she's the problem. She acted like no one ever gets hurt or died driving a car. :rolleyes

You're better off...as far as the future goes, ask the employer.
