Long, long ago, in a universe far, far away a Marine Drill instructor taught us all that if you ever find yourself in a "fair fight" you've badly miscalculated! How many times have you had a LEO lie in court under oath to make his case, I have. The law is there for BOTH sides to use, if said LEO isn't familiar with chances to court procedures then he deserves to be laughed at (as the Chippy in my case was by his homies waiting for thier cases to be called)

Trial By Written Declaration has been working for me. If i ever get the chance there's no doubt that i'll test this one out.

Well, I've only ever had one ticket (knock on wood) so maybe that's why I am not jaded. Oh well, once I get a bunch more I'll probably learn my lesson and catch up on the bitterness track :party For now though, staying out of trouble has really helped me avoid getting in trouble!
 
Actually there are several things the cop must say.
And he needs to rest before you can propose a dismissal.
If he does not say he rests, then you must ask him do you rest or
is there anything else you would like to add to your statement.

If he does not say he rests then he can go back and fill in the blanks.

Actually yes, strangely enough.

Goes something like this.

"I contacted the driver and he identified himself with a California Drivers License as Mr Barfer; who appears to be standing to my left"

If you don't "point them out" and the judge is paying attention, he'll dismiss it. Good luck though, because it is very rare that an officer will forget that.
 
Eh, that's what I'd probably do. So long as it's not a really dumb citation, but something like a speeding ticket- if I was speeding, I was speeding. I'll try to fight it, but I'm not going to fight dirty.

As you wish, but if you think others don’t fight dirty (court system, politicos, (city, state, fed) government, police officers etc) you are to say the VERY least: naive; but perhaps a far more stronger word would be appropriate, but could be construed as offensive.

Witness for the prosecution recounts identifying person arrested for crime. Witness for the prosecution identifies that same person (defendant) in the courtroom.

Just begs for me to have my brother come along and stand up there first and reply, "NCB will be a few minutes late Judge, he's stuck in traffic, but parking right now"- right after the copper points him out as the perp...:cool
