If you don't "point them out" and the judge is paying attention, he'll dismiss it. Good luck though, because it is very rare that an officer will forget that.

Question: A long time ago, an officer cited me for speed but she never asked me to remove my helmet before I signed the citation. Would that have been a similar technicality of positively identifying the individual...or, are officers not required to have you remove your full-face helmet at the scene?

...lastly, I'm just curious, what is this statute or rule that the judge would be basing his decision on when exempting you on this (albeit, far-fetched, good luck to-ya, don't hold your breath) technicality??
 
Eh...I've gotten a lot of tickets, and I have strong opinions about dealing with the system...but...

Man up and pay if you did it. You knew the consequences, you chose to speed or whatever. It's just a fine. What is the big deal?

If the cop was professional, and you don't have poor enough form that you've gotten caught multiple times in a short timeframe...STFUAP.

I find it amusing that so many people whine so much about speed enforcement, work so hard to get out of it, act like a dick to the cop, etc, etc and in the end, aren't all that fast all that much of the time really. Maybe tickets feel better when you really deserve them?

try to get out of them at any and all costs because how are you supposed to ride with a suspended?

having a sport bike and riding it even mildly is just asking for problems and obiously tickets can be avoided by obeying all laws but sometimes its just too hard not to just go vroooom!
 
What if you never took your helmet off and the picture on your CA license is old and looks nothing remotely like you. Sounds like it'd be an easy way to get off...

I got popped for 78 in a 55 and because I stopped, he wrote it for 60 in a 55. Not sure if I am going to fight it, as I can't really afford to be slabbing down doe for what the officer SAID HIMSELF: "it wasn't that you were driving dangerously, the radar just went off at 78mph." If I wasn't posing a danger, why write me the ticket? It's that what the laws are implemented for? Protection of peoples safety?

Of course. That was the reason, for example, for gun registration (later confiscation) in Germany by the National Socialist German Worker Party - not to mention many other laws in order to "protect" the public. This "noble cause" has been used through the course of history, and one must not forget that Robespierre created literally the “Committee of "Public Safety".
Certainly Ben Franklin knew his history and the habit of repetition.

And of course, it is fitting – as people today nor have liberty nor safety.

Hence the keyword, "appears". Its been tried before, but i've never seen it happen.

a lot will post up saying if you did the crime then pay the fine, but if I can get off on a technicality I will.

Please let me know when you are going to do this. I want to be there where your case is called, by name, and then you try to explain why your brother is representing himself as you, under oath, in court. DOH.:p

The signature on the ticket is just to have you acknowledge you WILL show up in Court...
