....at least that was the thought that was going through my head as I was driving to work this morning watching one of Fremont's finest yaping away on his cellphone with no Bluetooth in his ear...in his cruiser, on duty......:rolleyes

Lucky for him, I am not spitefull enough to take down his cruiser number and throw him under the bus with one of our many FPD customers......I should have..just for fun:teeth

it's legal for him to do, the law specifically exempts LEOs

only if it's in the spirit of his duties

which there is no way to prove it wasn't and this is the wrong place to be posting the thread anyways.

These guys are on here to help some of us understand the law better not to have you bash and abuse them

kthxbai

...well, now I understand that if it was a duty call he is allowed to, I was not aware of that.....so the law was explained to me...thus making this the right place to post:teeth

For the record, it was a personal call....or a very unprofessional duty call, waving arms around, laughing, obviously joking around in a social manner.

NorCal, whats that for? I'd love to respond, but instead of just telling you what you can do I figure I should at least get what angle you are coming from.

I know half of the FPD folks, I am LEO friendly, I obey most reasonable laws, this kind of thing just pisses me off...anytime a LEO takes advantage of their position or issues citations for something they themselves are guilty of, I just can't stand it.

Jumping to conclusions......

How do you know that he wasn't making a work related call?

Still, a double standard. Get used to it. They don't have to follow the rules

:rolleyes

How is it a double standard? LEO's are exempt from this law. Same with seatbelts.

Rel, like i mentioned before, I did not realize that it was OK for LEO's to use the cell w/out bluetooth, so my basic misinformation to begin with.....but, as I also mentioned, the way he was waving his arms around, gesturing, laughing and pounding on his steering wheel.

No big deal...just think it is funny when things like that happen...not funny ha-ha, the other kind of funny.

All for police officers being given lots of leway with regards to what they can/can't do, I am all for it. If I knew it was OK for them to take work related calls i would have probably not even posted. I respect the job, i respect most of the people that carry out the job....helps keep my lazy butt safe. It just rubbed me the wrong way this morning....sorry to those of you that got a bit defensive.

...and for the record, LEO's can jump to conclusions also....a friend got a ticket for talking on his cell the other day...when he wasn't. He was spitting sunflower seeds into a cup, I guess it looked like he was trying to hide his phone? Got pulled over, officer told him why he pulled him over...my friend explained what he was actually doing and that his phone was in his breifcase in the backseat, he couldn't even get to it while driving. The officer didn't care, the guy even got out the phone and pulled up the call history to prove that he was not on the phone 5 minutes earlier....officer didn't care. Actually told him that he would have only issued a warning....but since my friend lied and tried to make up a story he was going to ticket him...:rolleyes

Rant over. Not a big enough deal to keep thinking about....for me at least, yall can keep going if you want...hahaha.

.

And, I'd fight that ticket with all I've got. Additionally, I'd contact that department and start asking questions.

Can some LEO's chime in on why this may be? I know you guys are out there so maybe there are some experiences that hinder you guys from believing people, which i totally understand. But why in disbelieve even when it was proved? Or maybe this particular officer was just having a bad day.

I mean, yeah you could fight it, and might win. But it's still a lot of time and hassle. And I won't even be surprised if you lost. Side track...my friend got a parking ticket by a meter maid when there was still time on the meter. He saw the meter maid give him the ticket and asked him why, but it was too late because he has already printed the ticket he says, and that he'd have to fight it. Well he did, and he lost.

One just did. See the post above yours.

A: I dont know Teddy.
B: As far as I know, Teddy wasn't in the vehicle at the time of the stop.
C: We don't know the true interaction between driver and officer.

If the driver got a ticket for doing something he was not doing, it is his obligation to fight it.

He is definitely going to fight it, already has his cell records that show he was not on the phone anytime around when the officer pulled him over...he is just pissed that he has to now go and spend his time fighting the ticket.

I told him that I honestly don't even think the officer will show up unless there are other more pressing matters in court he'll have to deal with....obvously that was total speculation on my part, trying to make my friend cool down a bit.

Thanks for your thoughts on that!

Take an EVOC course and then consider how quickly you'd be able to egress your cruiser in an emergency situation whilst fucking with a seatbelt. :|

You should know better.

Uber double standard. Makes me respect LEO's more :thumbup

Way to go shit stirrer. It seems that you've never taken into account that officers are trained to NOT wear seatbelts. May seem a stupid concept to us civilians but it is practical in the execution of police officer duties.
