Hey, so this is an extension of a thread in the Motard forum. We're talking about using parking lots for practicing riding that would be considered too aggressive for the streets. I was wondering what the laws are about this. If it's illegal, is it like trespassing? Or more like a moving violation on a public road? What are the odds of getting busted for doing this since the idea is taking the aggressive riding off the street and into a more controlled environment? Thanks in advance.
 
I think its BS if they write you a ticket.

Kids in Tahoe say cops let them play in snowy parking lots as long as its not reckless in cars.

I play in dry and wet parking lots in my car and it helps your safety on the street. I bet i drive better than 95% of cars out there, because i autocross, and my car can out-slalom and out-brake 98% of cars on the road.

Cops still dont know the difference between "street racers" and "respectful racers"

So im sure the same can be said for "stunters" and "supermotos"

I gather it's technically illegal to drive recklessly on any public road including parking lots, but realistically, would they write me up if I have a license and plates? Would it me the same as reckless driving on the street?

I agree with you completely. The only point of contention I have is that Tahoe cops are cool as hell from what I've experienced. Driving by sheriffs on MX bikes on city streets without even a second glance, skiing down snowy roads after a big storm having cops nod at you as you ski by them. Very cool folks. Never had a problem with a Tahoe townie. CHP is a different story though.

See your first sentence. Yes it is illegal to drive recklessly in off street parking lots, so yes you are subject to being cited or arrested.

Would an officer write you up or arrest you? "Yes, no, maybe." There is no way we can answer that question for you.

Really? What if you owned the property? What if you happened to be driving through the lot as someone was driving foolishly and you got into a collision with them? What if they lost control in th elot and shot out onto a street and got into a collision? What if the neighboring homes and businesses don't want to hear the noise and see the mess left behind?

Granted these are all what ifs, but unfortunately too many people only think about themselves (why can't I drive like an ass in a closed parking lot) and not enough about everyone else.

That's why people have insurance and telephones and are able to make complaints. If the only person that has a problem with it is the officer, it seems somewhat pointless to write the ticket. Furthermore, I think the idea of "driving like in ass in a closed parking lot" (until someone asks you to stop because it is bothering them for some reason [they own the lot, or live near the lot]) is actually quite considerate when compared to "driving like an ass on public roads" Wouldn't you agree?

So again, would this be a moving violation like reckless driving on the road? Or is it considered a different matter because it's a parking lot. I'm just curious what I'd would get written up/arrested for.

It's not just the location you're at that determines a vehicle code violation, but the fact that you are just plain operating a vehicle, period, for some things.

Ok, thanks. That's exactly what I was looking for. I guess I'll have to suck it up and do the track day thing, until I find a friend that owns a warehouse somewhere.

I thought that the VC was largely unenforceable in a parking lot (save for DUIs) unless there were signs explicitly stating that the VC would be enforced. Is reckless another one of those exceptions?

There are a few threads on the subject, but yes, reckless is one of the sections of the vehicle code than can be enforced on private property.

And that is the exact attitude that I am talking about. It shouldn't have to be up to others to call to complain about your actions, or for them to rely on their insurance to cover them for your actions. You aren't allowed to ride like a hooligan in an off street parking lot. These laws are in place to protect everyone.

I would agree that you shouldn't ride like that in either location. Find somewhere that is private property where you have permission to ride the way you want and have at it. Sorry if I come off like an old man but I have seen too many incidents where people get hurt doing stupid stuff in vehicles where they shouldn't be doing stupid stuff. And it always seems like it is the innocent bystander or propertry owner who suffers the brunt of the incident and not the person who was driving like an ass.

Sounds an awful lot like ticketing jaywalkers in the middle of a flat desert if you ask me. Seems like doing something just to do it.

I agree that both locations could result in danger to someone. But there's an inherent list of things a human can do to result in harm to another human, and I would contend VEHemently that driving like a hooligan in a desolate parking lot is lower on that list than just getting into a car on the street. Or any number of other totally legal activities one can do with/on/in a vehicle. I have no way to know by your posts if you yourself would ticket an individual for parking lot hooliganism, so I can only assume you are giving justification for "IF" someone wrote me up for it. there are times when a cop has every right to write a ticket for this situation...then there are times when cops are on power trip robotic auto mode and would still write you a ticket, even up in the hills in an empty parking lot with nobody else around.

so if you found a good spot, told the cop you were testing out tires or breaking in your brakes, then it would be BS if they still wrote you up.

but yeah parking lots near a neighborhood or with potential cars passing thru, that should be a definite ticket because only idiots would choose that spot.
 
you know what just do it but be ready to pay the price if you do get caught or pay up if you destroy anything. I say let DARWIN decide. Thank you come, again!
