pepper sprayed for "walking too close"

You are factually incorrect. Several people are perfectly ok with the way everything went down, and are justifying her use of the spray.

And I agree; it was an over-reaction from someone who probably shouldn't be a cop anywhere but Mayberry.

Exactly. I don't like waht she did, but I certainly understand it and don't really care that much. It certainly isn't a big fukcing deal, just another BARF thread to slam teh popo. Which is my main complaint. Slam the popo for shit that's real and hideous, not this penny ante bull shit high school wahhhhhhhh my feeeeeeelingsssssss are hurt bullshit.

that old thing about calling wolf. If you call wolf for every mangy alleycat that walks by, nobody is going to care when you call wolf for a real wolf.

An over-reaction that should be analyzed by her superiors for sure. Escalate the scenario around her and she very well may start throwing lead down range with the red mist in her eyes.

Maybe. Maybe not.

I'm not interested in slamming the popo. I AM interested in not giving the police a free pass on something that would get anyone else jailed for assault. I bet it's a really big deal for the guy who got pepper-sprayed in the face, even if not for you. I'm not sure how you can claim he 'deserved' it. Nor do I see how it's relevant to her action. You wear the uniform, you get the stress response training, you should be held to an even higher standard.

As far as what's real and hideous - let's play out what happens if you use that defense yourself. "I know I crossed the DY into a blind turn back there, but nobody was coming. Hey, no blood no foul, right officer?"

No, of course that doesn't work; it's ethically and legally indefensible. Should it carry the same penalty as if I forced a biker off a cliff to his death? Once again no, but that's a separate discussion (and a separate charge).

I'm not sure what your wolf analogy is demonstrating. Save the cries of police injustice for when someone dies, but don't fuss over less hideous violations of free speech and free assembly? That seems like an odd line of argument.

First off: No one died.

Pepper spray sucks, but it washes off.

I've watched both videos.

If the officer deployed pepper spray to diffuse a bad situation, shit happens.

Who walks into an angry crowd (with cops shouting "get back!") with their head up their ass and an ear to a phone? That guy.

Victim-less crime argument. As stated above, that doesn't wash legally or ethically. Doesn't take a death to make it wrong. Not to mention, people have died from 'non-lethal' use of force before.

I'm not saying it was smart. But it seems challenging to make a legal or ethical case for contributory negligence. 'That guy' had his back to the officers, had walked past her, and his body language was about as non-threatening as it's possible to be. There was no obvious threat to justify her use of force. Ethically, her responsibility to avoid harming others isn't excused by his responsibility to avoid being harmed.

You remind me of the guy at teh restaurant who asks the waitress for a glass of water and complains to the manager that it was not cold enough.

I'll go ahead and bow out of this round of "nuh uh, you are!" and call you the winner by default.
Enjoy your hard earned victory.

First off: It was a protester that got sprayed, not anyone that matters.

Pepper spray sucks, and is in fact banned by the Geneva Convention.

I've watched both videos, and I'll act like I'm the only one that has.

If the officer deployed pepper spray because she is weak minded and starting to freak out and is suddenly operating on pure adrenaline and hippie hate, shit happens.

Who follows police orders to disperse and is sprayed by someone who is too high-strung to be anything but a liability to a police force? That guy.

Serious question, and you can pm the answer if it'll impact your credibility. Would you want that gal as your partner in a tense situation?
