Person smacks me in the head at a stop light

All those things happened to me. All were reported and every time an officer talked his way out of filling out a report. :thumbdown its important for people to know what situations they can't be protected in and when the police aren't accountable.

I think you got slapped with the bigger reality check that nobody cares. Sorry dude.

This is what I've learned in the last year or so. Assault is O.K. as long as you dont damage someone and an officer didn't see it or is obligated to help. You can smack or shove someone as long as it doesnt leave a mark. You can even loosen all the bolts on someone's vehicle so long as no bolts were taken or damaged. What happens to the vehicle after it's ridden isnt your problem. If his windows were rolled up, you could take a lead pipe and beat the shit out of his body panels while he was driving, then drive away. The cops won't care because he wasn't in any personal danger.

You can try a lawyer and see what happens tho.

So who, exactly, did the "mini peel out"? And to me it sounds like you might have been "racing". Were you doing anything that a cop would call "exhibition of speed"? (Note: You don't have to exceed the speed limit to be guilty of that.)
 
And if you and your friend are really completely innocent with this incident, they why not post the video?
 
Some people may find what I am about to say a bad idea but the next time someone gets out of their car and walks up to you don't just stand there. Get off the bike and be ready for things to get crazy and to defend yourself. It could have been a knife or a gun instead of a slap.

Pretty much. You're a sitting duck on your motorcycle unless you decide to use it as a weapon, and good luck explaining why you felt lethal force was necessary. How hard is it to push someone over on a motorcycle? Not very. At the very least your bike is going down. And facemasking may be a penalty in the NFL, but it's legal on the street...sooo many disadvantages while stopped.
 
haha ya I jsut got back for police station. They said they could've gave him a "slap on the wrist" if I called when the incident happened. Not that I could've anyways because I was on my bike...if I stopped to make the phone call, the guy would've been long gone anyways.

Since when is there a statute of limitations on reporting an incident to the police? Go back and talk to supervisors until you get someone willing to do their job. :wtf
 
I have a feeling that won't happen. Likely the OP will realize, upon further reflection, that he and his friend don't come off smelling or looking squeeky clean in the video.
 
Many LE agencies have policy that they do not take police reports on misdemeanors where the victim does not want prosecution. If the OP was asked what he wanted done about the incident and he told the officer he did not want prosecution, then that's where it ends.

He said in this thread he just wants the guy to get a "reality check." Well..... LE isn't in the business of reality checks. If you want prosecution, then say so. Just be aware that it may involve having to take time off work to go to court and testify in front of the suspect.
 
Guy was stupid to get out of his car, let the police do their job (though it seems they are not (cough*).

Sounds like the OP and his friend took off fast, but, I doubt thats what pissed the guy off. In any event, video or it never happened!
 
As I understand it, if you threaten to hit, it's assault. If you follow through with the threat, it's battery. And it's possible to have battery without assault though the two usually go together.
 
Sums up this entire thread.

Cliff Notes: Two dudes on motorcycles are riding like asshats in someone's neighborhood. Someone from the neighborhood confronts bikers and "slaps" him (hits his helmet). Now big bad biker who was all cool and lightin' up the tires earlier in the day feels the need to run and tell the police about a citizen who didn't like him riding like an asshat in his neighborhood.

So basically, someone acted like an asshat and another person acted like an asshat to the original asshat to stop the asshattery from continuing. Sounds like two asshats learned a lesson and the problem solved itself.

You do understand it's not okay to physically touch someone. If A calls B a cunt it's not okay for B to touch A.
