The National Highway Traffic Safety Administration (NHTSA) is offering federal funds that would expand the highly criticized practice of creating motorcycle-only checkpoints by law enforcement agencies.

Initially begun in New York State, the process involves setting-up checkpoints where only motorcycles are pulled over. Law enforcement officers then check for U.S. DOT-compliant helmets, legal exhaust systems, and compliance with licensing, registration and inspection regulations. The NHTSA program would also collect information on high-motorcycle-crash-incident areas and citations would be issued for any violations discovered.

The American Motorcyclist Association (AMA) has questioned the potential discriminatory and legal nature of this program and submitted a list of questions for clarification to the New York State Police. To date, New York authorities have not responded. The AMA has also sent a letter to Administrator Strickland urging him to suspend the grant program until questions have been addressed. While law enforcement officials in New York defend the program as a safety measure to decrease motorcycle crashes, injuries and fatalities, there is no proof of its effectiveness. The practice has drawn the ire of motorcyclists both locally and nationally.

The AMA believes public funding would better serve motorcyclists by applying it to the national motorcycle crash causation study that is currently underway. The primary source of motorcycle safety is in motorcycle crash prevention and NHTSA should focus on decreasing the likelihood of crashes in the first place. This is a sentiment supported by Congressman Jim Sensenbrenner (R-WI) and many of his colleagues in Congress through recently introduced H. Res. 1498. The methods used in New York State remain highly suspect and no public money should be applied to promoting such a program without addressing questions from the motorcycling community.

Specifically, how do motorcycle-only checkpoints (MOCs) increase the safety of motorcyclists? Where do the selected states draw their authority to conduct MOCs? Will “probable cause” be required to stop a motorcycle under the terms of this grant program? If so, what will constitute “probable cause?” What types of infractions were recorded by New York law enforcement officials at these checkpoints? And, what criteria will be used to determine if the MOCs are successful?

The AMA urges all riders to contact Administrator Strickland and request the grant offer be suspended until these questions have been addressed. Follow the “Take Action” option to send a pre-written e-mail directly to Administrator Strickland demanding no federal dollars be used to expand programs that discriminate against motorcyclists.

i don't really have a problem with the noise crackdown, frankly.

i also don't really see why motorcycle-only checkpoints would be particularly illegal, and i don't have a problem with being stopped and having my stuff checked out (obviously as long as it doesn't happen every day).

don't see why california can't go the way of other states and simply require a yearly inspection that results in a sticker being clearly displayed on the bike.

That said...
None of my bikes are particularly loud....but I still fear for my new Akropovic exhaust.

Love the idea, but unless you impound the bikes, this enforcement is a total waste of time. A $25 fix it ticket isn't going to change anything. Simply impound the bike and require the owner to remove the offending exhaust and return it to stock. Make em pay for the tow and the impound fees. That'd put a stop to the ridiculously loud bike problem very quickly. But as usual, the government never really fixes the problem.

talking with a cop who was part of this crackdown, he was surprised how many of these weekend warrior yuppie bikers didn't have a motorcycle license at all and their reasoning was cuz they never ride outside of SF on the freeway...

Though it would be hilarious to see an SFPD writing up an OPD for loud aftermarket exhaust. That would make great YouTube.

When did that play on tv? At the end the announcer said the crackdown will be in effect "all summer long". Does that mean last summer or next summer? :dunno
 
Got tagged a few years ago by a Walnut Creek motor cop, basically just a "check me out" stop, but he HAD to justify stopping me for SOMETHING (I'm white, so they couldn't use their normal reason), so he cites me for "non DOT exhausts. I fought the ticket, and when the officer arrived in the courthouse parking lot, I photographed HIS non DOT pipes (WCPD officers own their bikes, the city pays them to lease 'em, and when the lease is up they buy it out, so virtually ALL WCPD bikes have aftermarket pipes etc.) The judge refused to walk out and look at the officers bike, but I walked on a technicality. I guess what's good for the goose........:twofinger

I'd be down for the bike only stops IF they impound ANYONE's bike being ridden without a MC endorsement, but THAT will never happen. It'll be interesting to see how many squids crash tryin' to evade the traps. :rolleyes

The simple way to avoid EVER being arrested in SF is to claim that you violated Federal law by ILLEGALLY sneaking into this country. Just say yer gay, and in yer homeland of asscrackenstan (or wherever) you are being persecuted............the DA's office will buy you a house and send you a written apology for stopping you, as you are in a "sanctuary city" (GAG!) :twofinger
