Cop Shoots Man Stealing His Bike

Two men trying to steal a motorcycle soon found out the bike belonged to a San Diego police officer.

The off-duty officer heard noises outside his Nestor apartment around 9:30 p.m. Wednesday, looked outside and saw his motorcycle being carried into the back of a minivan, according to a police news release.

He grabbed his gun, ran outside and confronted the would-be thieves.

According to San Diego police detectives, the off-duty officer identified himself and ordered one man to the ground. After initially taking a knee, the suspect got up and walked towards the officer grabbing at him several times, detectives said.

“The suspect hit the officer, then turned and placed both hands inside the midsection of his jacket. Believing the suspect was arming himself, the officer fired his weapon and struck the suspect,” detectives wrote in the press release. “The suspect walked away, and the officer called 911 and followed him until responding units took him into custody.”

Eduardo Gonzalez, 28, was sent to the hospital for a non-life-threatening wound.

The minivan along with the motorcycle, a 2008 black Yamaha R1 bearing California license plate RAVEN1Km was last seen heading northbound on Interstate 5 from Palm Avenue.

The officer involved in the shooting is a 3 ½ year veteran of the department, currently assigned to Southeastern Division, police said.

Score one for the good guys.

Another bike almost jacked by two guys and a minivan. Actually it was jacked, with the second perp, minivan and bike making their escape.

Another sad reminder to properly secure/lock up your bikes fellow Barfers. Lot's of grinches out there during the holidays ready, willing and able to jack your property.
 
Hopefully the guy they caught will lead them back to the accomplice.
 
That bike headed northbound? Right. Its already stripped into 100 pieces and being repainted in a special Tijuana gold flake sparkle.
 
More bullets in bike thieves would have made this story better... But I still like it!

I'd say the fact that the thief is still alive and the van got away without flat tires and a new bullet hole ventilation system is evidence that the cop showed incredible restraint.
 
'Sounds like the cop handled it right. Identified himself. The perp goes down to one knee, then feels bold and comes at the officer. Still the officer is playing it cool. Then the perp starts digging around in his jacket. Time to take action. No sympathy here for the sorry-ass perp.

And yea, hope he gets his bike back in one piece.
 
I agree with the basic tenent that ANY thief should be killed slowly.

BUT...

Did the thief admit that he "turned and placed both hands inside the midsection of his jacket. Believing the suspect was arming himself, the officer fired his weapon..." Was the thief reaching for 2 guns? Why both hands?

A justified shooting needs to have a clear and present danger of life threatening action by the assailant. If that action can't be verified, the officer is in a world of trouble. Civil AND criminal!

What if he shot someone else too? A civil suit will cost him WAY more than any deductible! C'mon man, its insured!

Ever tried drawing a pistol out from underneath a jacket or other clothing? Frequently takes 2 hands and that's the standard method taught in most classes. One hand to clear the clothing, the other to draw the weapon.
