VW "Clean" Diesel not really clean

My nephew-in-law has a Passat TDI that he has to turn in. He asked VW what condition the car has to be in and they specified that it has to be running. That's it. His only plan is to swap his 18" OEM wheels for my 16" OEM wheels. :teeth He's a good kid.
 
The U.S. courts are courts of equity, where judges have a lot of leeway in interpreting contracts and establishing an equitable settlement between two parties. It's not a simple matter of reading exactly what's in the contract to the letter. Guy's a douche and I hope he gets boned.
 
Don't forget he called VW several times before turning the car in and the failed to provide any details beyond the words if the contract.

VW was very specific in the contract that they just wanted running cars, it's not like they hadn't put language in describing exactly what they wanted.
 
Did they say "you can take any parts off the car you want, the only requirement is that the car is running" or did they say "the car must be running." Believe it or not, there is a distinction.

Archimedes matter of equity are definitely something that's good to know about, but equitable claims are a slightly different animal; that is to say, you generally wouldn't pursue a breach of contract claim as a matter of equity. The implied covenant of good faith is actually codified in California UCC 1304, so while it feels like it's equitable, in a legal sense it's actually not.

Laughing! Fuck that term is bullshit "courts of equity". We've gotten boned on that term a couple times too. Tenants walk from leases with strong language and signatures and we end up with the empty bag. You're in the Biz...you get it.

Going through the legal system gives clarity. It's a crap shoot.

I just did a round trip to Ridgecrest. Scared shitless the whole time a lights gonna go on and the fuel pump will be toast. I started using power service's diesel clean (white bottle) every fill up. Just 4oz per gallon. Supposed to help with cold diesel and pro long life of fuel parts.
 
Sure you can afford to maintain that dubs? Look up how much brake parts cost.

How much are 2007-2009 Range Rovers going for at auction? Not sure I want to get rid of the F150 but I drove a 2012 RR Supercharged the other day and it was nice.

2012 is too new for what I want to do though, I actually want to take the thing off road and it has to be cheap enough that if I accidentaly destroy the thing my wife won't destroy me. :laughing

I wonder how aggressive of a tire I can get for the 20's that come with the Supercharged. I don't think an 18 will fit over the brakes on one of those.

I've been dreaming about outfitting one of those with some nice tires, two way radio, and some off road equipment and hitting the snow or the woods with the boys. Go out and play in the cold and then come back and jack up the heated seats. :teeth
 
I'm glad I got the Audi to replace the TDI. I just wanted to send a big FU to VW- I'm not buying one of their cars again!
