it was one of those rare times when i decided not to lane-split!!! well, another lesson learned (the hard way) paramedics were surprised to see me walking around like nothing happened. i guess i need a new pair of pants though :)



I'm not a sue happy person...but this is an open & shut case- you don't even need someone with legal background to represent you in winning this one.

She seems like a nice old lady, don't take her to the cleaners. She drives a newer car and probablyy has liability insurance. If you owe on the bike, you probably have some kind of comprehensive coverage as well. Your/her insurance company might lowball you but I think if you can negotiate with them. One gal I knew got her car totalled, the insurance company wrote her a check, she didnt cash it but instead called them up and negotiated citing a bunch of classified ads with the same bike year/mileage condition going for more. The insurance company eventually paid her enough to get a replacement which was *ahem* slightly nicer.

If that don't work, tell the insurance company your back really hurts and you need to see a chiropractor regular for 12 months plus you need all new jacket, pants, helmet, and gloves. :p

I am surprised, too. Man, buy a lotto ticket, just in case the goodness spreads to all things. Just wow. Good luck with the insurance companies. I hope you get your money, fast.

You went through the same thing I go through, "I don't want to talk, I just want to sit/lay down for a moment"

No. Your insurance company should handle everything. Lay it on them. If they don't perform, then you sue THEM.

I wouldn't care if she was a convicted felon or mother teresa... if you rear end me and get parts of my beloved motorcycle half way into my ass, you're going to hear from my lawyer in a big way.
 
make sure u add up what it really will cost you cause her insurance will defiantly try to give you the least amount of money and also depending on her limits on collision n what not... hell you can prob get a lawyer to just write a letter with all the damages and youll get a nice settlement
 
Wow, I am so sorry! I have some great German cream called Kytta Salbe that's great for muscle aches, etc. I'm really sorry about your bike, too.

Wow, you handled that like a boss. No screeching tires, I bet if she didn't hit you she would've hit the SUV in front of you.

Surprised only one person said it, but go to the hospital. What feels fine now may be you lying in bed tomorrow.

the worst part is i still owe a lot (probably more than what the ins. is gonna pay) on that bike! as i said i will probbably think about all those with a clear mind tomorrow!

Go the ER, get documentation of injuries, stop talking about it here, then go get a
Lawyer!

Next time, stay flat on your back till you see a check with 7 decimal places, to the left of the decimal point, that is....

it is almost an everyday thing now, ever since someone cut in front of me without signaling couple of weeks ago, causing me to brake hard enough to do a stoppie :) i think i have posted a pic of it here too! i think every rider should have one!
