Assuming (and this may be assuming a great deal) that insurance does what it's supposed to do (OP's and asspackin' granny's), what sort of lawsuit do you all envision coming from this? (For those among you who foresee an actual suit)

I'm not trying to get my troll on, and I'm not asking for fringe-outlying-what-ifs. I'm curious what kind of legal action you think happens after a (let's face it) run-of-the-mill rear-ender.

I guess maybe the short answer is that a lawyer helps make sure the insurance companies do in fact do what they're s'posed to. An attorney makes sure the non-property (medical etc.) aspects are handled. But beyond that? Am I missing something that turns this into a tort goldmine payout-vanganza for the OP? :dunno


I don't think it's time to Lawyer up. The insurance companies need to have their opportunity to get the issue handled and get the OP taken care of asap to his reasonable satisfaction.

My suggestion would be to start leaning on them from the get go and make sure to the best of his ability that he is given his due.

Failing that, then it would time to lawyer up.
 
First off: I'm glad you're ok, though I hope you get your back checked soon. I live with back pain and it SUCKS.

second:the timing of your post is incredible!
I was in my car today and I watched a barfer almost suffer the same thing. The driver swerved at the last millisecond to run over his foot and hit his leg instead of full-on rear ending him and his bike. The rider has video of the incident from the gopro he keeps running every time he rides.
 
That is straight up hard to watch, glad you are okay. I would go to the doctors ASAP so that its at least on record that you were concerned for your own well being. They may also give you some nice pain meds to help with the soreness tomorrow.

there was nowhere to go with "lane splitting though" -- the time is so short, that a rider doesn't have time to look in the left or ride mirrors and split past the dark SUV. In reality there could be another car speeding past in the left or right lanes and they could sideswipe you, should one decide to split.

And one more vote AGAINST tinted windows, especially tinted windows on big SUVs.. they should be banned, like in other places.

If the back window wasn't tinted maybe you would've seen through, that there is a backup in front--and would have avoided it. In fact, between cars, that's why backups sometimes happen --because they can't see through.

it was one of those rare times when i decided not to lane-split!!! well, another lesson learned (the hard way) paramedics were surprised to see me walking around like nothing happened. i guess i need a new pair of pants though :)

Don't second guess yourself. The car in front of the car you were following stopped for no apparent reason. Sometimes shit happens. Just get yourself checked out, and take it easy tomorrow. It will likely hurt like crap.
 
If that don't work, tell the insurance company your back really hurts and you need to see a chiropractor regular for 12 months plus you need all new jacket, pants, helmet, and gloves. :p

Well, you are supposed to replace safety equipment after it's been in an accident, right? Definitely price out replacements for the best jacket, boots, helmet and gloves you can find and add that to whatever number you think you deserve.

Machines can be replaced, and the point of the insurance is to make you whole. How long have you had the bike? If you haven't had it long you should argue that you should be given MSRP, not blue book. They don't like doing that, but they will sometimes if the vehicle is new enough. They did that for me on a 9 month old car that was totaled out.

+1 on getting checked out. You'll probably be feeling something tomorrow , sux about the bike but its replaceable.
 
Get checked out and get a lawyer also get that video off youtube and delete this thread because if their is litigation they will try to use it against you no matter if it looks clear cut or not.
 
That was intense. Glad you're okay. In the video it seemed like you looked in your rearview before the accident, did you manage to see the car coming and/or react at all?

If your hospital visit goes well (fingers crossed) you might be able to get away with having the insurance take care of everything, no lawyers needed. Good luck.
