how would an officer properly re-identify you? by just stating that you're the same person he stopped? does he need to look at your license again?

The officer can "point you out" to the judge. (at which point you can say "Don't point that thing at me, it has a nail in it......or not.)

I am not a sportsman when it comes to my driving record. If any LEOs choose to be offended by that, tough break. The judge is already on their side. It's a crapshoot. No way that insurance rates should be based on your driving record when, in some places, you can get 5 tickets just driving down the street, and other places you can go backwards on the freeway with your car on fire and nobody blinks.

A clean record doesn't mean you're a safer driver. Maybe it means you have a good lawyer, or don't live in cop hell, or only break laws that the cops don't stop people for.

And I haven't been pulled over in 8 years. *shrug*

If you're innocent, then yes win however necessary. I don't mean "I don't deserve this ticket", but you are accused of driving 75 in a 65 when you were doing 55 on your GPS.

I'm sure BARF'ers know when they are innocent or not, perhaps they were simply suggesting when they know they are guilty, that they will be good sports :thumbup

If we lived in a world where both sides played fair I would have no problem owning up to the government...but the way things are, no citizen owes any government authority and kind of courtesy or respect or honesty, except on a civil level. Business is business, and they are already taking too much of our money and wasting it.

Eh, that's what I'd probably do. So long as it's not a really dumb citation, but something like a speeding ticket- if I was speeding, I was speeding. I'll try to fight it, but I'm not going to fight dirty.

I mean using technicalities. I believe in the spirit of the law, not the letter.

Let's not make this into a debate, I believe what I believe and you guys believe what you believe. You don't need to 'correct' me, it's my choice and you can't change my ethical code in this regard via the magic of the interwebs.

The gov't has no ethics. The point is you shouldn't feel bad for it, cause you're getting the short end of the deal regardless

People who kill people in their cars and are able to keep on driving, make me feel less guilty for getting off on technicalities...

How do you plan on fighting a ticket then? I guarantee you you will not win a ticket by saying what you believe. For the most part, you have to present factual evidence, and connect them to specific parts of the vehicle code.. being technical and all :nerd

If you go to court to fight a speeding ticket when you know you were speeding, then aren't you also playing dirty? If you were speeding and you want to be totally honest, then just pay the ticket and let everyone else who wants to try to fight their's.

Anyhow, I'd like to see where in the VC it states that the officer must identify you. Granted I wasn't paying specific attention to this detail when I was doing my homework for my ticket a few months ago by sitting in on court trials, I did recall most officers in their opening statement say that they identified the defendant to their left as the same individual they got their autograph from.

I sure as hell hope any of you guys who go into court trying this out have a backup plan on grounds to fight your ticket by. :rolleyes

I may be wrong but a bailiff buddy of mine told me the officer has to sniff your butt to confirm you are the individual they cited previously.

So to get out of a ticket you just gotta eat a large bean burrito with some extra cheese before a hearing? :laughing

Long, long ago, in a universe far, far away a Marine Drill instructor taught us all that if you ever find yourself in a "fair fight" you've badly miscalculated! How many times have you had a LEO lie in court under oath to make his case, I have. The law is there for BOTH sides to use, if said LEO isn't familiar with chances to court procedures then he deserves to be laughed at (as the Chippy in my case was by his homies waiting for thier cases to be called)
