Well it's going to be judged an accidental death at the very minimum but if any intoxicants are found in either party, it will put an entirely different perspective on the accident. And at that point some blame will be placed on the intoxicated participant.

You are pretty tiresome with the constant bagging on dirt track racing. You do realize there is a board member who dirt track races cars and was cool enough to share his experiences with the board? Those were great threads.

Your comment about Stuart makes no logical sense. If his ability to drive is truly exceptional, if he has total control of his race car, if he "legit", then it follows that this was not just a unavoidable accident. Stuart made driving decision that effected the performance of his race car.

My comment about Stewart was that he is an exceptional driver and he didn't deliberately try to kill the guy. To me that does make logical sense.

He wasn't bright to get out of his car and get on the track, but it is obvious to me that stewart was high and the only one to hit the guy. There was no reason to be that high and he could have avoided the whole thing.

someone died as a direct result of Stewart's actions (Stewart ran a person over, whether it was deliberate or not hasn't been fully determined imho)

if this were on the road, I feel it would be vehicular homicide

I hope Stewart had an in-car camera so we/police can see exactly what his actions were.

I find it hard to believe he'd intentionall kill someone over that wreck. In the grand scheme of things he races dirt for the love of the sport not for fame money or the potential to kill someone.

IMO, he either didn't see him or didn't have time to react when he did see him. If it was intentionally then it would have been the result of a psychotic break, he may have had "anger issues" (more like media filled nascar bullshit hype from the past to raise ratings) but murder is a whole different level.
 
I highly doubt he intended to hurt him. The guy should not have been on the track. Stay in the car.

My take is deliberately was trying to get close and intimidate the dude. Manslaughter. I doubt charges will be filed.
