OP - As Nick said, a person exhibiting the behaviour like that GTI driver most likely does not want to chit chat. Next time, after he got out of the car, pass the car on the right (I understand there might be traffic or your buddy) and let him stand in the midst of the road like an idiot.

Everything else will not turn out in your favour. Unless you are armed and you can properly respond to whatever that shithead pulls out of his wasteband :)

If that were me as soon as I saw that GTI stop in front of me like that, in the middle of the road, and the driver start to get out, I would have blown past that dude either on the right or over the dy. I wouldn't want to wait around to see what was coming.

Its important for civilians to know how important numbers and spreadsheets are to PD's, and because of this, it's an officer's job to talk as many people out of reporting incidents as possible.

As someone else mentioned, pass on the other side and get the hell out of there. Don't just sit there like a lump on a log and wait for some shit to happen. I had some lunatic on a bike want to race me once on Mathilda in Sunnyvale. I shook my head no and he took off and up and over the overpass over the SP tracks. As I came up to the top, I found that he'd stopped just over the rise in the middle lane and had gotten off his bike, pulled the seat up and had a big wrench (like a 1" open end/box) in his hand and was waving it threateningly. I faked going to the right, cut left and down to the light and pulled a U turn on a red at the fire station and was gone. I wasn't going to stick around and see what some crazy was going to do.
 
Go easy on him. I mean, he did read an article in a newspaper. Surely that can replace the years of collective knowledge and experience of those who have and are currently doing the job, yet telling him otherwise. Right?!?!?
 
Wow. That moment is exactly why you have titanium knuckles on your gloves. Should have put them to the test buddy. I had something similar happen to me a while ago. Only it came from behind and the guy had a gun to my face.

It's sad, but there's really nothing a motorcyclist can do but GTFO in a situation like that.

The guy stepping out of his car is an act of aggression, but if the motorcyclist got off his bike in preparation to defend himself, or at least make himself less vulnerable, then, at best, it would be considered mutual combat, or at worse the motorcyclist now becomes the aggressor.

If they fought and the guy grabbed the helmet chinbar and fucked the biker up it wouldn't go any worse for him, but if the biker headbutted the guy to defend himself then the biker would be charged with use of a weapon.

There's really no way to win as the motorcyclist except to GTFO...and good luck when he chases you.
 
Give him the BARF salute and a chuckle and get the hell out of there. Really just take off when he stopped and got out.

Personally if someone cut me off and stopped, I would be going around them without missing a beat. You have no idea what the guy wants and staying around to figure it out is a bad idea.

They should if the victim wanted prosecution and the suspect was identified. Depends on the DA. And it's a misdemeanor battery with no injuries. It won't be a high priority case and, if they did file, would probably take them months to do so.

I linked to an official lawsuit against compstat by a fellow officer that included tons of substantiated evidence including recordings of other officers doing exactly what I'm talking about. It is what it is.

Having been through a similar incident without video proof, I would have followed up and made repated calls to the DA until they pressed charges. This guy is a POS that needs to be taken off the road.

The fact that the cops on here seem to think this is a non-issue reiterates my impression that the law truly is in OUR hands. Prior to the road rage incident I dealt with, I would probably have dealt with it much like the OP. Knowing what I know now, one or both of us would end up in jail or the hospital.

Bojangle and Tharkun, shame on you for your attitude towards this. That was about as cut and dry of a case of battery and road rage as I have seen. Yeah, nobody got hurt. But the fact of the matter is, the guy committed a crime and it is your job to deal with it, especially considering the evidence. Hell, there is a license plate, a car description, a very clear photo of the perp, and video evidence of the action. And yet you guys react with "Ho hum"?

Up until a few months ago, I was one of the biggest supporters of cops on this site. Whenever somebody posted upa "fuck the police" thread I almost always took the cop's side. Now, I find myself in the other corner more often than not. And your comments in this thread, well, my response is "Fuck the Police". Now get out there and write some more tickets. After all, it's about revenue, not stopping crime.

Our country is fucked.

The OP's original post flat out says he didnt want to prosecute. You know that means no citizens arrest and a misdemeanor not committed in the officers presence means no criminal report.

If the OP showed up at the PD and said he wanted to file charges / a citizens arrest, you would be correct l; But it's pretty clear the OP didnt ask for that and thus, it goes away.
 
I get that. It's the attitude and straight up "The DA will not press charges for that" mentality that bothers me. In other words "It's a fucking free for all. Take matters into your own hands."
