CHP Causing a Motorcycle Accident

Funny thing about emergency vehicles. With lights activated, they can break the law. Same reason an officer can break the speed laws to catch up to speeding vehicle. If every officer could only drive 65mph, they'd never write any speeding tickets.

With Lights activated, they are specifically exempt from certain rules- they aren't violating anything. Speeding, to catch up to a speeder, is not exempted by the vehicle code, but happens all the time. Go figure.

I never said the officer was at fault...just that IMO his actions contributed. Yeah, the rider freaked out, but why did the LEO feel the need to cut in so close? Personally I wonder why he didn't just continue and pull in front of the entire group. I'd be willing to bet this experience changes his future decision making.

Honest, I respect you guys a lot, but why are you so defensive? Everyone makes mistakes. Hell, I'm not even saying ther was one here...just that it seems questionable from what I see.

i guess i interpret "request" as meaning pressured, as meaning someone with some clout "suggested", as basically meaning censored in a sneaky indirect way.

anyway, i saw the clip, and i think the cop made a very poor decision in how he approached the bikers. you could not tell what happened prior to the recording, but there is no excuse for how aggressively he moved in on the group and the close proximity he was to the one rider especially, unsafe in every way. it's not like the riders were running away at high speeds, they were just barely putting along for christ's sake. there were several other ways he could have pulled the whole bunch over without any problems, and i could see how his actions might have startled someone and caused an accident. good job ossifer :thumbdown

21056. Section 21055 does not relieve the driver of a vehicle from the duty to drive with due regard for the safety of all persons using the highway, nor protect him from the consequences of an arbitrary exercise of the privileges granted in that section.

to insure safe operation shall give audible warning with his horn.

(b) The horn shall not otherwise be used, except as a theft alarm system which operates as specified in Article 13 (commencing with Section 28085) of this chapter.

The CA DMV handbook also says this:
Your horn can let others know you are there and can help avoid an accident. However, it can also startle others and could be dangerous if used unnecessarily.


My ONLY point in all of this is that it isn't unheard of that drivers get spooked. It was a contributing factor...nothing more and nothing less. Not saying it was the LEO's fault, and can't believe he intended anything, but I hope he keeps it in mind next time he's in a similar situation. At least I would.
