FINALLY - Lane Sharing is supported in CA

I'm pretty sure local jurisdictions need explicit permission to enact ordinances for areas state law already covers. For example, parking. Locals can pass ordinances cause there's a whole crapload of sections that explicitly let them do it.

Since there's no state law that specifically covers lane sharing, the cities shouldn't need that explicit permission.

But again, there's nothing in the California Vehicle Code that specifically makes lane sharing illegal or legal. Therefore section 21 wouldn't apply.

CVC Section 21 said:
Except as otherwise expressly provided, the provisions of this code are applicable and uniform throughout the state and in all counties and municipalities therein, and a local authority shall not enact or enforce any ordinance or resolution on the matters covered by this code, including ordinances or resolutions that establish regulations or procedures for, or assess a fine, penalty, assessment, or fee for a violation of, matters covered by this code, unless expressly authorized by this code.
 
I am so pleased about this--changing minds in hidebound state agencies is truly hard work.

Nothing but honor and applause for Silversvs and Budman for fighting the good fight, and devoting their blood, sweat and tears to the lanesplitting cause. It really drives home the point that a handful of intelligent, committed citizens can change things for the better.

You seem to just be stuck on this idea that the vehicle code doesn't cover operation of vehicles on highways...not sure where you are stuck with understanding this, so I'm having trouble explaining. All I can say is to read some codes. Locals only can enact ordinances covering vehicle operations on roadways if the vehicle code lets them do it.

Start at 21000 and read.

Rules of the road are governed by the vehicle code. That covers everything, even lane splitting. Locals can only pass laws for things they are given explicit permission to pass laws for. Lane splitting isn't one of those things and therefore they cannot regulate it.

Very good news, agreement and clarification are long overdue. :thumbup

The guidelines suggested are the very same ones I use every time I lane split - which is a rare occurrence for me due to my riding pattern. That, and every time I do lane split, I'm as nervous as a cat in a dogpound.
